False Land Act Abdul Halim, Former BPN Jaktim Officer Demanded 1.5 Years In Prison

JAKARTA - The public prosecutor charged former BPN surveyor at the East Jakarta Regional Office, Paryoto, with a sentence of one year and six months imprisonment. The prosecutor considered Paryoto guilty of committing the criminal act of forgery of the authentic certificate of land in Cakung, East Jakarta belonging to Abdul Halim, covering an area of 5.2 hectares.

"Demand, that the panel of judges declare Paryoto legally and convincingly proven guilty of committing the criminal act of letter forgery as stated in Article 266 paragraph (1) Jo Article 55 paragraph (1) of the Criminal Code," said the prosecutor while reading out the charges at the East Jakarta Court, Wednesday, November 11th.

The prosecutor considered things burdensome and lightened Paryoto. What is burdensome is that Paryoto's actions caused Abdul Halim to be unable to issue a land certificate of 5.2 hectares.

"In the meantime, the defendant was polite, admitted his actions and became the backbone of the family," said the prosecutor.

In his lawsuit, the prosecutor detailed that this illegal act began on June 5, 2011. At that time, Paryoto had an assignment signed by the Head of Section for the Regional Office of BPN Jakarta, Aag Nugraha ST to measure nine parcels of land with evidence of 9 SGHB in Cakung, Jakarta. Timur, on behalf of Benny Simon Tabalujan, covering an area of 5.2 hectares. Paryoto also carried out the order by taking land measurements.

"Furthermore, when the defendant was at the exact location in Kampung Baru, Cakung, East Jakarta, the defendant only measured a stretch of land which had been surrounded by a wall consisting of 20 SGHB in the name of Benny Simon Tabalujan," said the prosecutor.

The measurement of land owned by Benny Simon Tabalujan (DPO) was witnessed by Achmad Jufry (DPO) as the attorney of the land owner who served as the person who showed Benny Simon Tabalujan's land without knowing the actual boundaries.

After taking the measurements, Paryoto ordered Achmad Jufry to sign the measurement report in the owner's column which Achmad Jufry found out when he showed the boundaries of Benny Simon Tabalujan's land, he could not show Benny's power of attorney.

After completing the measurement, a field map was made as the basis for issuing 27 measuring letters. With the publication of 27 measuring letters, Benny Simon Tabalujan used it to issue 27 SGHB.

Then, in 2017, Abdul Halim, who had proof of land ownership, took care of the certificate issuance process. On October 8, 2018, based on the letter from the Head of the East Jakarta Land Office on an area of 5.2 hectares, 38 certificates were issued under the name of PT Salve Veritate.

"Meanwhile, Abdul Halim has issued 13 AJBs on the land since 1980," said the prosecutor

Knowing that the land was controlled by someone, Abdul Halim also took legal action by reporting this case to the Police. Until finally the police appointed Paryoto, Achmad Jufry and Benny Simon Tabalujan. However, Benny Simon is currently a police fugitive. Benny Tabalujan is in Melbourne, Australia.
