SURABAYA - I Gede Pasek Suardika, the head of the legal advisory team, the obscenity case with the defendant Moch Subkhi Azal Tsani (MSAT) said the indictment read by the East Java High Prosecutor's Office Mia Amiati was unclear. Therefore, the lawyer filed a memorandum of objection (exception) against the indictment of the Public Prosecutor (JPU).

"What we have excluded is because it is a vague indictment. We regret why it has to be online today and why the trial was moved from Jombang to Surabaya. If it's online, it's still in Jombang, right, if it's in Surabaya, please present it so that we both seek justice. The incident accused is fact or what is accused is fictitious. It can be tested", said Pasek, after the trial at the Surabaya District Court, Monday, July 18.

Pasek explained his reasons for mentioning the prosecution's indictment were unclear. According to him, the news in the mass media mentioned that there were dozens of female students who were victims of their clients, but the fact turned out to be only 1 person and she was 20 years old at the time of the incident.

"And today the victim is 25 years old. So I am also surprised that what is conveyed in the media and the indictment is very different", he said.

In the trial, explained Pasek, there was a long debate regarding two things. The first is an online question but without notification to the lawyer.

"We hope that the defendants and witnesses are all presented. We just gather like this, it's okay, why don't we dare to seek justice. So finally the panel of judges interceded with each of them submitting a letter with their arguments, I attended the trial in Jakarta, there was no problem, it's different", he said.

Second, continued Pasek, he admitted that he had not received the Report of Investigation (BAP) to this day. For that, he then submitted the BAP request.

"We also propose that. Why is it so difficult, things like that are basic things in the Criminal Procedure Code. So let us together seek material justice. Judges, advocates, and prosecutors alike seek material truth. So it's not all about whether the incident being accused is fact or fictitious", he said.

Pasek said that during this time his client's extended family, Mas Bechi, rarely explained to the public. So the trial of opinion is experienced first.

"And today we explain slowly. Only 1 person presented and was not as bombasted as before. Therefore, we want to know what the full BAP looks like. If someone is wrong, please try them but don't try people who are not clear about what their faults are", he said.
