Court Kabulkan Habib Bahar's Assimilation Suit, Directorate General Of Social Affairs Submits Appeal

JAKARTA - The Directorate General of Corrections (Ditjenpas) will appeal in response to the Bandung Administrative Court (PTUN) decision which granted Habib Bahar bin Smith's attorney team's lawsuit regarding the letter of revocation of assimilation by the Bogor Correctional Center.

"The advocacy team held a meeting to discuss legal steps to file an appeal," said the Head of Public Relations and Protocol at the Directorate General of Public Relations, Rika Aprianti, when confirmed, reported by Antara in Jakarta, Monday, October 12.

Rika said that the advocacy team was a combination of the West Java Provincial Office of the Ministry of Law and Human Rights, the Secretariat General (Setjen) of the Ministry of Law and Human Rights, and the Directorate General of Social and Political Sciences.

Previously, the Bandung PTUN Panel of Judges granted Habib Bahar bin Smith's attorney team's lawsuit regarding the revocation of assimilation letters from the Bogor Correctional Center which was declared invalid.

"In the exception, the defendant rejects the exception entirely. The trial on the subject of the dispute granted the plaintiff's claim in its entirety," said Chairman of the Bandung Administrative Court Council, Faisal Zad in Bandung, Monday.

In this dispute case, the team of attorneys for Habib Bahar bin Smith served as the plaintiff, and the Bogor Correctional Center (Bapas) as the defendant.

In the trial of the verdict, the judge accepted the lawsuit from the plaintiff in its entirety. Thus, the Decree of the Head of the Class II Bogor Correctional Center Number: W11.PAS.PAS33.PK.01.05.02–1987 dated 18 May 2020 concerning the Revocation of the Decree of the Head of the Class IIA Cibinong Penitentiary Number: W11.PAS.PAS.11. PK.01.04-1473 Year 2020, declared invalid.

Thus, the judge ordered the defendant to revoke the decision letter and give back the right of assimilation to the convicted juvenile molestation case, Bahar Smith.

Rika said that her party respects the decision of the Bandung State Administrative Court Judges. "We respect the decision of the Bandung State Administrative Court Judge canceling the Decree of the Head of Bogor Bapas," said Rika.

It is known that Bahar Smith was sent to Gunung Sindur Prison again on Tuesday (19/5) after being released through assimilation rights on Saturday, May 16.

Bahar was returned to Mount Sindur because the assimilation program that was given was revoked because Bahar was deemed to have violated the assimilation provisions.

As is known, Bahar gave a lecture at his boarding school, Tajul Alawiyyin, after being released through assimilation rights. In this activity, the congregation who attended seemed to ignore health protocols.
