Ferdinand Hutahaean Undergoes First Trial Of Hate Speech Case 15 February

JAKARTA - Social media activist, Ferdinand Hutahaean is scheduled to undergo his first trial on Tuesday, February 15. Ferdinand will be tried at the Central Jakarta District Court

"The trial of the Defendant Ferdinand Hutahaean will be held on February 15, 2022, Tuesday according to the schedule set by the Court," said Head of Legal Information (Penkum) for the DKI Jakarta High Prosecutor's Office, Ashari Syam as quoted by Antara, Friday, February 11.

Previously, the Public Prosecutor (JPU) of the Central Jakarta District Attorney (Kejari) had transferred the case files and suspect Ferdinand Hutahaean to the Central Jakarta District Court (PN) on February 2, 2022 for the purpose of administering trial registration.

Then the judges of the Central Jakarta District Court (Jakpus) set a trial schedule for the hate speech case that ensnared Ferdinand Hutahaean.

The Public Prosecutor's Office of the Central Jakarta District Attorney has received the case file and the submission of the suspect along with the Phase II evidence in the Ferdinand Hutahaean case from the Criminal Investigation Police investigators on Monday, January 24.

There is also a suspect Ferdinand is suspected of having committed a crime of broadcasting or telling false news that caused trouble in the general public with a tweet on Twitter that read "Your God is weak".

Ferdinand is also suspected of conveying hate speech or hostility towards certain individuals and/or community groups based on SARA for his tweets.

Then, intentionally in public express feelings or commit acts which are essentially hostile, abuse or desecrate a religion adhered to in Indonesia.

Ferdinand was suspected of having violated Article 14 paragraph (1) of the Republic of Indonesia Law Number 1 of 1946 concerning the Criminal Law Regulations.

Subsidiary, Article 14 paragraph (2) of RI Law Number 1 of 1946 concerning Criminal Law Regulations, or Article 45A paragraph (2) in conjunction with Article 28 paragraph (2) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Transactions Electronic (ITE) or Article 156a letter a of the Criminal Code or Article 156 of the Criminal Code.
