Minister Of Manpower Letters To Governor Who Sets UMP Not In Accordance With Provisions, From Jakarta To West Papua

JAKARTA - The Minister of Manpower (Menaker) Ida Fauziyah said that she had written to regional heads who set the provincial minimum wage (UMP) for 2022 which was not in accordance with the provisions of Government Regulation Number 36 of 2021 concerning Wages.

"We convey that, in our context as manpower coaches, we have written to the governors which will then be used as the basis for the Minister of Home Affairs to carry out coaching according to their authority," said Ida Fauziyah in a working meeting with Commission IX of the DPR, quoted by Antara, Monday, 24 January.

Ida explained that there was one province that set the 2022 UMP not in accordance with the provisions, namely Southeast Sulawesi.

In addition, there are three provinces that set the 2022 UMP not according to the minimum wage calculation formula, despite announcing it according to the deadline, namely Riau, East Nusa Tenggara and West Papua.

There is also DKI Jakarta which revised the increase in the 2022 UMP to 5.1 percent, bringing the amount to Rp. 4.6 million. The 2022 UMP revision made the DKI Jakarta Indonesian Employers Association (Apindo) finally sued the PTUN.

Ida said in the letter, he had asked the regional head who issued the 2022 UMP policy that was not appropriate to return to the provisions of PP No. 36 of 2021.

"We obey and comply with the laws and regulations. We have carried out the process. We invite the governors to obey and comply with the provisions of the laws and regulations," he said.

He explained that PP No. 36 of 2021, which is a derivative of the Job Creation Act, remains valid, provided that the regulation was issued before the decision of the Constitutional Court was announced.

As for President Joko Widodo's directives, Ida said, the Constitutional Court did not cancel any articles and the job creation law remained in full force and effect.
