When People Supported That Herry Wirawan Who Raped 13 Female Students Sentenced To Death, Komnas HAM Rejected It

JAKARTA - The defendant in the rape case against 13 female students, Herry Wirawan (36) was demanded the death penalty by the public prosecutor (JPU) from the West Java High Prosecutor's Office (Kejati).

A number of DPR members, ministers, regional heads, and the community support the death penalty demands. However, this is not the case with the National Human Rights Commission (Komnas HAM).

"Komnas HAM does not agree with the demand for the death penalty," said Komnas HAM Commissioner Beka Ulung Hapsara in a short message to VOI, Thursday, January 13.

Beka admits that he agrees with the assumption that Herry deserves to be punished severely for his depraved acts. However, he said, not by depriving him of his right to life because it violates human rights principles.

"In the principle of human rights, the right to life is a right that cannot be reduced under any circumstances or is a non-derogable right," said Beka.

Instead of the death penalty, Beka believes that Herry can be sentenced to a maximum prison sentence of life imprisonment.

As is known, the defendant in the case of raping 13 female students in Bandung, Herry Wirawan, was sentenced to death by the public prosecutor. Herry was found guilty of committing such acts of obscenity against dozens of his students.

"In our demands, first we demand the defendant with the death penalty. As proof of our commitment to provide a deterrent effect on the perpetrators or on other parties who will commit (sexual) crimes," said Head of the West Java High Prosecutor's Office Asep N Mulyana after the trial at the District Court Class IA Bandung, Tuesday, January 11th.

Asep who became the public prosecutor also revealed that the second charge against the defendant was in the form of additional punishment in the form of chemical castration.

"Secondly, we also imposed or asked the judge to impose additional penalties in the form of identity announcements distributed through judges and additional penalties in the form of chemical castration," he said.

The third claim, Asep said, his party also asked the panel of judges to impose a sentence of Rp500 million and a subsidiary for one year in prison and oblige the defendant to pay restitution to the children of the victims, a total of Rp330 million.
