Asabri Corruption Case, 2 Private Parties Sentenced To 10 And 13 Years In Prison

(LCGP) Lukman Purnomosidi was sentenced to 10 years in prison and PT Jakarta Emiten Investor Relations Director Jimmy Sutopo was sentenced to 13 years in prison for being proven guilty of jointly committing corruption in the management of PT Asabri funds that cost the state Rp22.788 trillion.

The verdict is lighter than the demands of the public prosecutor (JPU) of the Attorney General's Office, which demands that Lukman Purnomosidi be sentenced to 13 years in prison plus a fine of Rp. 750 million, subsidiary to 6 months in prison.

Lukman is also required to pay a replacement money of IDR 715 billion less the assets that have been confiscated and if not paid his property will be confiscated and when there is insufficient he will be sentenced to 4 years in prison.

The obligation to pay the replacement money is also different from the prosecutor's demands that Lukman pay compensation of Rp. 1.341 trillion, subsidiary to 6.5 years in prison.

"The aggravating thing is that the defendant's actions have resulted in enormous state losses, do not support government programs that are free from KKN, the defendant's actions were planned, structured and massive, the defendant's actions caused distrust or distrust of the capital market and did not admit his guilt," said judge Eko. .

There are also mitigating factors, Lukman is considered cooperative and polite in court, is the backbone of the family, and has never been punished.

"The trial, stated that the defendant Jimmy Sutopo was legally and convincingly proven guilty of participating in a criminal act of corruption and money laundering. Sentencing the defendant to be jailed for 13 years plus a fine of Rp. 750 million, which if not paid was replaced with imprisonment for 6 months , said Judge Eko.

Jimmy's verdict is lower than the demands of the Attorney General's Office, which demands that Jimmy be sentenced to 15 years in prison plus a fine of Rp. 750 million, subsidiary to 6 months in prison.

Jimmy Sutopo was also charged with paying a replacement fee of Rp314.868 billion by taking into account the confiscated evidence and documents and if not paid, his property would be confiscated and if it was not sufficient, he would be sentenced to 4 years in prison.

"It was found that the defendant Jimmy Sutopo spent corruption money by buying land and apartments, buying movable objects, namely vehicles with the aim of disguising the origin of wealth, exchanging money from corruption crimes into foreign money which was then bought for land and apartments," said the judge.

During the trial, a judge who expressed a dissenting opinion was judge member 5, Mulyono Dwi Purwanto regarding the method of calculating state losses by the Supreme Audit Agency (BPK).

Judge Mulyono revealed that Jimmy Sutopo controlled PT Asabri's shares as of December 31, 2019 amounting to Rp. 765 billion from the purchase price of Rp. 314.868 billion or an increase of 247 percent so that Jimmy's actions gave PT Asabri a profit of Rp. 450.273 billion.

Regarding Lukman's act of buying shares worth Rp715 billion which has not been returned, Judge Mulyono assesses that the ownership is not clear and the value enjoyed by Lukman is not clear, so the state losses are not clear, not real and uncertain.

This means that judge Mulyono assessed that the state loss of Rp. 22.788 trillion based on the BPK report was still in the form of potential and not real state losses. However, four judges namely Ignatius Eko Purwanto, Saifuddin Zuhri, Rosmina, Ali Muhtarom agreed with the BPK report.
