JAKARTA - When talking about Law No.28 of 2014 concerning Copyright (UUHC) which is a guideline on music royalties in Indonesia, it is important to see its synergy with UUHC which applies in other countries.
This is because Indonesia, as a member of the United Nations (UN), has ratified the World Intellectual Property Organization (WIPO) convention or the World Intellectual Property Organization.
Candra Darusman as an Indonesian musician who has worked as a consultant to Deputy Director of WIPO said UUHC in Indonesia has met standards according to agencies that offer various services to protect intellectual property across borders and encourage settlement of intellectual property disputes outside the court.
"When the Law (Cipta Rights) was made, it was usually submitted to WIPO, where I worked (previously), and WIPO would provide comments. And the comment said it had met the standards," said Candra Darusman when met after attending a discussion with ACTIONs in Senayan, Central Jakarta last week.
However, said Candra, there is a note that the UUHC is lacking in providing explanations between articles that have the potential to cause controversy, which is a debate among Indonesian music personnel at this time.
"So, what's missing is the explanations. Usually, if it's the law, there is an explanation for the article. It's not filled there," said Candra.

"If the explanations are filled, then the controversy between articles does not occur," he added.
Even so, Candra feels that the current UUHC does not completely fail to protect the rights of songwriters.
"If, for example, UUHC is disabled, WIPO will reprimand, but no. What's missing is the attachment in that explanation," he said.
For information, the UUHC revision is set to be included in the 2025 Priority National Legislation Program (Prolegnas) in the DPR RI.
