Denying FESMI's Statement, Ari Bias Calls Singers A User Who Must Pay Royalties

JAKARTA - The Federation of Indonesian Musician Unions (FESMI) through an Instagram upload stated that promoters/EO (event organizers/generators as Users, who must pay music royalties, in the context of performing right live events.

However, Ari Bias, who recently won the lawsuit against Agnez Mo, did not believe so. He said the FESMI statement was based on the habits carried out in Indonesia, and not from Law No.28 of 2014 concerning Copyright (UUHC).

"In my opinion, FESMI said that because that's what has been going on based on habits. But this has become the judge's decision, and the judge's decision has legal force and is based on law," said Ari Bias in Tendean, South Jakarta, Wednesday, February 5.

The mandate of Law Number 28 mandates that users in a show, especially shows, are not other things, they are singers. Now that's the judge who spoke, and that's based on the law," he continued.

He believes that the decision of the panel of judges at the Central Jakarta Commercial Court to decide the case is the right decision.

"The judge must have decided based on a logical and strong policy, yes, it's not just random. So so far there has never been a decision like this, so far it's only interpreted from each person to interpret each other individually, it finally happened like that," said Ari.

"But that habit is not necessarily true, but this has already been a legal decision that the user is a singer in the show, like it or not, what has been going on (it's) wrong," he added.

Furthermore, Ari explained his belief, why the singer is a user, who is required to pay the roylati to the Creator.

"That's why all this time it's been chaotic, it turns out that it was because of the logic, the one who knows song list is the singer, who knows the title of the song, who knows the creator is the singer, EO doesn't know, it's rare for anyone to know," he said.

"Well, see, the beginning of the song was chosen and determined, it was the decisive singer. So that should be the case. If that's the case, what goes on, God willing, the creator will be neat, the economy will fulfill it, because it started with the singer himself who proposed," concluded Ari Bias.
