PEKALONGAN - Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN) Nusron Wahid revealed that only 45 percent of waqf land throughout Indonesia was certified. The total waqf throughout Indonesia reaches around 661,909 plots of land.

"Well, the number is in Indonesia 561,000 and I am sure there are still many mosques, prayer rooms, violations that are not registered. My calculations add another 100,000," said Nusron in his remarks at the Delivery of KKN Force 63 Thematics of Ecoteology and Land in Pekalongan, Central Java, Monday, October 13.

Nusron even joked, usually the mosques belonging to Nahdlatul Ulama (NU) often do not have waqf land certificates.

"Usually the mosque or illegal violations that are not registered are NU, if Muhammadiyah is orderly," he joked.

According to Nusron, there are three obstacles that cause the large number of waqf land to be not certified. First, there is no/incomplete waqf land rights base document.

So far, there have been many obstacles in controlling the Ikrar Waqf Deed (AIW), even though AIW is an important document that becomes the basis for waqf land certification. Therefore, it is necessary to strengthen synergy and collaboration, especially with the Ministry of Religion (Kemenag).

Second, there is still a view in society that the land that has been donated does not need to be recorded, documented or administered.

This is based on the assumption that recording is deemed unnecessary because the land has been sincerely distributed and there are concerns that it will be considered 'riya' if the administrative process is carried out.

Third, the large number of waqf land has not been separated from the parent certificate. When there is an increase in land, for example because there is a national strategic project (PSN), the land that has been donated is taken back by its heirs.

"Where there is a national strategic project, it used to be considered that the land was not considered because it had no economic value. Once a power plant was built, a toll road was built, a national strategic project was built, its heirs, wakif children who used to care not, (so) demanded the land," explained Nusron.

"This is in Tangerang, Banten, Cirebon, Indramayu, Subang, all the way along the toll road," he added.
