Wow, The Findings Of The Ombudsman There Are Still 100 Companies That Have Not Paid Their 2020 THR

JAKARTA - The Indonesian Ombudsman supervises the payment of the 2020 religious holiday allowance (THR). The findings are that there are still companies that have yet to fulfill their obligation to pay THR payments to their workers or laborers.

Ombudsman member, Robert Na Endi Jaweng, did not disclose the exact number. However, he said there were around 100 companies that had not paid their THR payments in 2020.

"It turns out that there are still around 100 companies in 2020 that have not paid in full, maybe even haven't paid anything to workers," he said in a virtual press conference, Wednesday, May 5.

Robert emphasized that it is not a matter of the number of companies that have not paid yet, but the labor rights must be fulfilled. He said the Ombudsman had two jobs this year.

The first is related to carry-over or the continuation of the 2020 THR problem which must be resolved immediately. Second, today's challenges.

"We want the government to seriously resolve the carry-over first, which happened last year and is still ongoing today, has not been paid off. Second, of course, what is in sight in 2021," he said.

Furthermore, Robert reminded that there are sanctions for companies if they do not carry out their obligation to pay THR to workers or laborers. This provision is contained in Government Regulation Number 36 of 2021 concerning wages.

The regulation explains about sanctions in the form of fines and administrative sanctions ranging from written warnings, harsh reprimands, restrictions on business activities, to the end of freezing business activities.

"This is an administrative sanction that has been regulated in the Wage PP which is derived from the Job Creation Law, PP Number 36 of 2021," he explained.

Previously, the Minister of Manpower Ida Fauziyah said that based on the final recapitulation as of June 4, 2020, his party had received 410 complaint reports related to the payment of the Idulfitri holiday allowance (THR) last year. Of these, 307 companies have completed the inspection and made THR payments.

"There are 103 other companies in the process of inspection, supervision and service summons for the implementation of examination notes one and two. Some of them are related to industrial relations disputes that are still in process," he said, Monday, April 12.

As is well-known, the government allows private companies to postpone or installments of Religious THR payments in 2020. However, these installments or postponements of THR payments still have to be completed in 2020.

This permit is contained in the Circular (SE) of the Minister of Manpower Number M / 6 / HI.00.01 / V / 2020 concerning the Implementation of 2020 Religious Holiday Allowances in Companies during the Corona Virus Disease 2019 (COVID-19) Pandemic.

"The consideration at that time was the consideration of business continuity and the needs of workers or laborers in fulfilling the THR needs," he said.

Meanwhile, this year, the government requires entrepreneurs to pay the full THR on D-7 Idul Fitri. This is stated in the SE Minister of Manpower Number M / 6 / HK.04 / IV / 2021 concerning the Implementation of the 2021 Religious THR for Workers or Laborers in the Company.
