JAKARTA - The Ministry of Maritime Affairs and Fisheries (KKP) emphasized that islands cannot be traded, because there is no legal basis that allows transactions of these geographical entities in Indonesia.
The Director General of Marine Management of the KKP Koswara said that in anticipation of advertising for the sale of islands, the KKP is ready to synergize with the Ministry of Communication and Digital Affairs (Komdigi) and publish the profiling of small islands in Indonesia through official websites.
"We emphasize that there is not a single regulation in Indonesia that allows the sale of small islands. What is allowed is related to its use for certain activities, land rights, and investments. That is also with strict conditions," Koswara said as quoted by ANTARA, Sunday, June 22.
He conveyed that the KKP has the authority to grant permits or recommendations for the use of small islands, permits for the use of small islands and the surrounding waters for foreign investors, and recommendations for the use of small islands with an area of under 100 square kilometers for domestic capital growers.
Since 2019 through the Regulation of the Minister of KP Number 8 of 2019, the KKP has regulated related to the limitation of the use of small islands.
Furthermore, he said, small island land cannot be completely controlled, there is at least 30 percent of state-controlled land for both the protection function, public access, and other public interests so that which can be utilized is at most 70 percent of the island's area.
"Of the 70 percent that can be utilized, business actors are required to allocate for green open spaces," he said.
Director of Coastal and Small Islands of the Directorate General of Marine Management of the KKP, Ahmad Aris, added that to avoid the recurrence of advertisements for selling islands online, the KKP has taken steps by sending letters to the Ministry of Communication and Digital Affairs.

In a sustainable manner, the KKP also carries out socialization or education to the public regarding the use of small islands, mechanisms and procedures for licensing small islands, as well as activities that are permissible and should not be carried out on small islands.
"With the increasing public understanding, it is hoped that it will reduce the potential for conflicts in the use of resources and environmental damage on small islands and can increase the use of islands legally and sustainably," he said.
The KKP encourages the use of small islands to be prioritized for ecotourism, conservation, sustainable marine cultivation, and marine research activities, all of which must be carried out in a legal and transparent framework.
The use of small islands must meet the requirements for environmental management, capabilities and sustainability of the surrounding water system, as well as using environmentally friendly technology.
