JAKARTA - The Ministry of Industry (Kemenperin) emphasized that buying and selling or trading the iPhone 16 in Indonesia is still illegal. It will not issue an International Mobile Equipment Identity (IMEI) for producers or distributors.

Even so, it is not only the Ministry of Industry that can issue IMEI. Referring to Government Regulation (PP) Number 46 of 2021 Article 35 states that the Directorate General of Customs and Excise can issue IMEI with a number of conditions.

Spokesperson for the Ministry of Industry Febri Hendri Antoni Arif said, referring to the regulation, the number brought should not be more than two units per passenger.

"The iPhone 16 series that enter Indonesia with passengers and paying taxes are luggage that cannot be traded and is limited to the personal use of passengers," said Febri in a written statement, Friday, October 25.

Meanwhile, the Ministry of Industry ensures that the application for imports from Apple producers is not issued as long as the company does not meet the commitment of the domestic component level (TKDN) in the form of investment realization.

Until now, his party is still waiting for the realization of Apple's investment commitment of IDR 1.71 trillion. The realized amount is IDR 1.48 trillion.

"The iPhone 16 shipment imported by registered importers cannot be marketed domestically, because PT Apple Indonesia has not fulfilled its investment commitment to obtain TKDN certification for the innovation scheme," he said.

Based on Regulation of the Minister of Industry (Permenperin) No. 29 of 2017 concerning Provisions and Procedures for Calculating Domestic Component Values, Cellular Phone Products, Handheld Computers and Tablet Computers, the government provides easy schemes to achieve TKDN requirements, the first is the manufacture of domestic products which are considered the most ideal.

Second, the application scheme, they create applications domestically. Third, the domestic innovation scheme. Minister of Industry Agus Gumiwang Kartasasmita said, of the three schemes, Apple as the iPhone manufacturer chose the third scheme, namely innovation.

Thus, the Ministry of Industry warned cell phone distributors not to look for loopholes in trading the iPhone 16 because it has not extended TKDN certification for Apple.

"The Ministry of Industry monitors the issue of the circulation of iPhone 16 mobile products, considering that the Ministry of Industry has not issued a TKDN certificate for the latest cellphone product released by Apple," he concluded.
