Munaslub's Efforts To Overthrow Arsjad Rasjid Mengahi AD/ART

JAKARTA - The Indonesian Chamber of Commerce and Industry (Kadin) Management Board stated that efforts to hold an Extraordinary National Conference (Munaslub) proposed by a number of provincial Kadins were contrary to the Indonesian Chamber of Commerce and Industry's articles of Association and Bylaws (AD/ART).

"Observing the development of information circulating regarding the plan to hold an Extraordinary National Conference (Munaslub) of the Indonesian Chamber of Commerce and Industry by a number of parties, we as the Indonesian Chamber of Commerce and Industry's Board see this effort as creating a situation that threatens the harmony of the Kadin organization throughout Indonesia as the government's strategic partner in building an inclusive and sustainable economy," said Deputy Chairperson for the Organization of the Indonesian Chamber of Commerce and Industry Eka Sastra as reported by ANTARA, Friday, September 13.

In addition, Munaslub's efforts with the agenda of replacing the general chairman also have the potential to cause divisions within the organization which will later harm the climate of the national business world.

Eka explained that the Indonesian Chamber of Commerce and Industry is an organization that functions as a forum for businessmen and strategic partners of the government which is stipulated based on Law Number 1 of 1987 (UU Kadin) and emphasized in Presidential Decree No. 18 of 2022 concerning the Indonesian Chamber of Commerce and Industry's AD/ART, where M Arsjad Rasjid PM is the General Chairperson of the Indonesian Chamber of Commerce and Industry elected for the 2021-2026 term of service.

Arsjad Rasjid was elected by acclamation as Chairman of the Indonesian Chamber of Commerce and Industry for the 2021-2026 term of service based on a joint decision at the VIII National Conference of the Indonesian Chamber of Commerce and Industry dated June 30, 2021, in Kendari, Southeast Sulawesi.

"That way, all Kadin members, both Regional Chamber of Commerce and Industry and Extraordinary Members, have a legal obligation to carry out the mandate of the law and enforce AD/ART in organizational activities," said Eka.

In accordance with the Indonesian Chamber of Commerce and Industry's AD/ART, the Munaslub can only be held if there are violations of the principles contained in it, and even then after being given two written warnings that were not heeded.

In addition, the request for the Munaslub must be submitted by at least half of the total number of Provincial Chamber of Commerce and Industry and half of the number of Extraordinary Members.

"Until now, we as the Board of Management have never received a warning letter regarding violations committed by either the Board of Directors or the General Chair. Therefore, we both at the Provincial and Regency/City levels, and all Extraordinary Members remain solid and united, and firmly state that we do not support the Munaslub because it violates the AD/ART," said Eka.

He added that the current situation and dynamics are part of organizational travel. However, the spirit of prioritizing the AD/ART mechanism in accordance with the Kadin Law and the Kadin Presidential Decree must be the basis for organizational travel.

"We urge the parties to wisely take a united stance and prioritize the interests of the organization for the advancement of the national economy. The challenges of the economy in the future are increasingly difficult and cannot be achieved if the business world does not work together and collaborate in an inclusive and mutual cooperation in the spirit of Bhineka Tunggal Ika," he said.
