The Ministry Of Energy And Mineral Resources Has Prepared A Ministerial Regulation On The EBT Electricity Sale And Purchase Agreement

JAKARTA - The Ministry of Energy and Mineral Resources (ESDM) is preparing the latest Ministerial Regulation (Permen) which regulates the Electricity Sale and Purchase Agreement sourced from New Renewable Energy (EBT).

Director of Aneka Energi Baru and Terbarukan (EBT) AndriahFebyMisna said this rule is a mandate of Presidential Regulation (Perpres) number 112 of 2022 which will specifically regulate PJBL specifically for EBT.

Feby said that the Ministry of Energy and Mineral Resources had issued a regulation regarding the PJBL EBT, namely the Ministerial Regulation (Permen) of Energy and Mineral Resources number 10 of 2017.

"But it's not complete, so in this new regulation we arrange it more fully," said Feby, quoted on Sunday, January 21.

He explained, in this latest regulation, various types of EBT will be included today, and several things that are not yet available in the pre-published regulations will be added.

He detailed that several things that will be included in the latest Permen will accommodate the Build-Own-Operate-Transfer (BOOT) and Build Owner Operate (BOO) schemes which will be based on several parties. The BOOT scheme is a inter-private cooperation scheme and the government provides opportunities for the private sector to build, operate at a certain time and provide services. later ownership will be handed over to the government at the end of the concession period to be continued.

Meanwhile, the BOO scheme is a form of cooperation that does not contain elements of ownership transfer at the end of the concession period.

Second, what is regulated in the latest regulation is the Domestic Content Level (TKDN) which was not listed in the previous regulation.

Furthermore, there are additional environmental attributes of Carbon Economic Value (NEK) which will adjust to regulations.

"Then related to the provisions of refinancing the utility of PJBL EBT," continued Feby.

A new regulation will also be added for the intermittent EBT. Later, private power-revival companies or IPPs will be given the obligation to collect project implementation data such as monthly and annual energy production.

"The data facility is adequate and is able to collect data on energy production projections according to applicable standards," he added.

Later there will also be additional special transaction arrangements if EBT has energy storage facilities, and finally an extension of the contract period for existing PJBL.

"If you look at PJBL candy previously for PLN projects, this candy will apply to business entity projects holding business areas other than PLN," concluded Feby.
