Regarding The LNG Aquarius Ship, Observer: Must Be In Line With The Cassation Decision Of Heru Hidayat In The Asabri Case

JAKARTA - It is known from the Supreme Court Case Investigation Information System that the panel of judges has rejected the public prosecutor's cassation and granted objections related to the confiscation of the LNG Aquarius ship in the Asabri case.

It is known that the LNG Aquarius ship belonging to PT Hanochem Shipping was confiscated in connection with the PT Asabri corruption case. Responding to the decision, Fajar Trio, an observer from the Prosecutor's Office, believes that law enforcement should be able to guarantee legal certainty for economic actors so that the company's business continuity can continue.

"All the people must support the prosecutor's efforts to eradicate corruption. However, as law enforcers, the prosecutor's office must also comply with the judge's decision regarding their obligation to return the LNG Aquarius ship and its documents. Because the law must ensure legal certainty, in particular, so that the business continuity of the ship company continues," said Fajar in Jakarta, Wednesday, December 20.

Fajar said that the condition of the national economy would develop if there was support from other sectors including support from the legal sector and law enforcement agencies. Therefore, the role of law enforcement agencies and officers in the development of investment for the Indonesian economy is vital.

"Don't because you don't comply with the judge's decision, the prosecutor actually makes investors or BUMNs afraid to invest and do business activities due to legal uncertainty and law enforcement behavior that often find faults with business actors," he said.

According to him, if the prosecutor obeys the objection decision number 4330 K/Pid.Sus-Kbrt/2023 from the panel of judges, it will create an acceleration of economic development for the welfare of the people.

"This means that all structural elements of the government and state, especially the prosecutor's office and the judiciary must be able to cooperate because it can directly create legal certainty and certainty of doing business in Indonesia to increase investment," he said.

However, Fajar also emphasized that the company PT Hanochem Shipping must also prepare for the potential for the LNG Aquarius ship to be re-absorbed by the Attorney General's Office.

"Currently there is still an Asabri cassation case with the convict Heru Hidayat who has not broken up. So if the decision states that Heru Hidayat was cut off by including the LNG Aquarius ship in the list of assets confiscated for the state, then just get ready the Aquarius ship will be confiscated again," he said again.

For information, the prosecutor in the Asabri case confiscated evidence in the form of an LNG Aquarius ship belonging to PT Hanochem Shipping, along with all ship documents. However, the panel of judges assessed that the ship was proven to have PT Hanochem Shipping long before the corruption crime in this case, bought 3 consortiums since December 14, 2011, the price of 33 million US dollars, so it is not the result of a crime and must be returned.
