JAKARTA - Indonesian Audit Watch (IAW) asked the government not to stop at the implementation of the Constitutional Court (MK) ruling which requires telecommunications operators to provide options so that the remaining internet quota can still be used. The government is encouraged to audit the historical data of the wasted internet quota to calculate consumer rights.
The decision of the Constitutional Court Number 273/PUU-XXIII/2025 must be a momentum to evaluate the management of internet quotas comprehensively, including preparing a restitution mechanism for customers who lose benefits from data packages that have been paid.
"The court has confirmed that the remaining quota has economic value and must be protected. Now the question is no longer whether the quota is allowed to be wasted, but how much the economic value belongs to the people who have been lost for years without choice, without compensation, and without ever being audited publicly," said IAW Founding Secretary Iskandar Sitorus through a written statement, Saturday, July 25.
Iskandar said the decision read by the Constitutional Court on July 23, 2026 did not remove the concept of the active period of the internet package. However, operators can no longer delete all the remaining benefits that customers have purchased just because the active period of the package ends.
"What the Court corrected was not the existence of the active period, but the system that allowed consumer economic rights to disappear without fair protection options," he said.
Furthermore, Iskandar assessed that the ruling changed the way of looking at internet quotas which had been considered to automatically expire when the active period of the package was over.
As for his consideration, the Constitutional Court stated that the remaining internet quota is an economic benefit that consumers have paid for, so it is related to the protection of property rights and fair legal certainty as guaranteed by the 1945 Constitution.
The court also asked operators to provide various service options, ranging from accumulating quotas, extending the validity period, transferring benefits, compensation, refund, to other forms of protection without charging additional fees to customers.
"Until now, operators consider the relationship with customers to be completed when the active period of the package ends, even though some of the quota has not been used. Now, the commercial interests of companies can no longer be the only basis for removing the economic benefits that the public has paid," he said.
In addition, Iskandar also proposed that the government prepare a historical restitution scheme for consumers. Because, the unused IAW reaches around IDR 63 trillion every year with an accumulation of IDR 613 trillion in the long term.
"Historical restitution must be based on verifiable data. The government needs to know who the affected customers are, how much the quota is lost, how the transaction value is calculated, and the most appropriate form of compensation," said Iskandar.
Then, the audit of the Financial Audit Agency (BPK) examined aspects of state financial management related to PT Telkom Indonesia and its subsidiaries.
Iskandar assessed that the ideal examination is carried out through five layers, namely regulatory audit, information system audit, accounting audit, fiscal audit, and consumer loss value audit. In the accounting aspect, the examination also needs to refer to PSAK 72 on revenue from contracts with customers.
"The Supreme Court's decision is a correction to the consumer protection system, not a criminal verdict. If later there is an allegation of fraud, collusion, or abuse of authority, all of them must still be proven through audits and applicable legal processes," he explained.
"The court has corrected the burnt quota regime. Now it's the country's turn to calculate its legacy and ensure that the rights of millions of consumers are truly restored," concluded Iskandar.
