JAKARTA - The lawyer for PT Indobuildco, Jaja Setiadijaya, assessed that the implementation of the eviction of Block 15 of the former Sultan Hotel in the Gelora Bung Karno (GBK) area, Senayan, Central Jakarta, on Thursday (18/6/2026), still left a number of legal issues.
However, Jaja emphasized that his party still respects the authority of the Central Jakarta District Court in carrying out the execution of the eviction.
According to Jaja, one of the problems lies in the technical execution, especially regarding the reading of the court's decision which is not carried out at the location of the executed object.
"The reading of the execution determination was carried out in the East Parking area of Gelora Bung Karno (GBK), not at the object that was executed," Jaja said in his statement, Thursday (18/6/2026).
He emphasized that this would be one of the grounds for PT Indobuildco to take further legal steps.
In addition, Jaja also highlighted the legal basis for the implementation of the execution which refers to the Decision Number 208/Pdt.G/2025/PN.Jkt.Pst. According to him, the decision only ordered the emptying of the object of dispute without determining the party that was declared as the legitimate owner of the land and building that became the object of the case.
He also referred to the 2011 Review Decision No. 276, which has long been used as a reference in the dispute.
"There is no decision that explicitly states that the land of former HGB 26 and HGB 27 and the buildings on it belong to the State Secretariat or state property," he said.
Therefore, Jaja assessed that the execution still left legal issues that should be resolved first before the evacuation was carried out.
Furthermore, he questioned the legal aspects of the execution. According to him, based on the Supreme Court Circular (SEMA) Number 3 of 2000 and SEMA Number 4 of 2001, the execution of the immediate decision must be accompanied by a guarantee whose value is equivalent to the object to be executed.
"However, until now, we have not received information about the existence of this guarantee from the court," he said.
On the other hand, Jaja emphasized that PT Indobuildco still holds Building Use Rights (HGB) Number 26 and 27 obtained based on decisions of authorized agencies in 1972 and 1973, and has been extended in 2002.
According to him, if the land is to be included in the Management Rights (HPL), then first the right of release and compensation must be given to the HGB holder in accordance with the applicable provisions.
"PT Indobuildco has never lost the right to the land because it has never relinquished the right or received compensation," he said.
Regarding the allegation of paid masses who carried out the rejection of the execution, Jaja admitted that he did not know the problem. He emphasized that his position was only as a lawyer who focused on handling the legal aspects of the dispute.
Currently, continued Jaja, there are still a number of legal efforts underway in court related to the dispute over the land of the former Sultan Hotel.
"Including resistance lawsuits and other cases related to land acquisition claims in the Senayan area in the period 1959 to 1962," he explained.
Previously, a total of 3,161 joint personnel of the TNI and Polri were deployed to secure the implementation of the execution of the ex-Hotel Sultan in the Senayan area, Central Jakarta, Thursday morning.
The execution process was marred by riots between the mass of execution opponents and the joint police. The police then deployed tactical vehicles with water cannons to disperse the crowd.
In addition, a number of people suspected of playing a role as provocateurs were also secured by law enforcement officers.
Before the emptying process was carried out, the clerk read the Decision of the Central Jakarta District Court Number 208/Pdt.G/2025/PN.Jkt.Pst and the Determination of the Central Jakarta District Court Number 1/Pdt.Eks/2026/PN.Jkt.Pst as the basis for the execution.
