MIP Case Hearing Enters Executional Stage, 3 Defendants File Objections

JAKARTA - The continuation of the case of alleged kidnapping and murder of the head of the bank branch with the initials MIP (37) entered the stage of reading the objection note (exemption) from the defendant at the Jakarta Military Court II-08, Monday, April 13.

Court spokesman Arin Fauzam confirmed that today's court agenda was entirely focused on the presentation of objections by the legal advisory team of the three defendants.

"This morning, the reading of the objection or objection from the defendant to the indictment submitted by the military prosecutor," said Arin.

He added that the trial, which was scheduled to start at 09.00 WIB, had not entered the witness examination stage. "Today's agenda is only an exception," he said.

The three defendants, namely Serka MN, Kopda FH, and Serka FY, were previously charged with involvement in a series of kidnappings accompanied by the murder of the victim. In this stage, the objection is an initial defense effort to test the validity of the indictment, both in formal and material aspects.

Through the exception, the defendant can question a number of fundamental things, such as the inconsistency of the description of the indictment, error in persona, to the court's authority to try the case.

The panel of judges will then consider the contents of the objection before deciding whether the case can proceed to the proof stage. If the objection is rejected, the trial will continue with the agenda of examining witnesses.

This case has become a public spotlight because it involves a serious criminal act with the main charge of Article 340 of the Criminal Code concerning premeditated murder, accompanied by a number of other alternative and cumulative charges.
