Former Regent of East Lombok Returns State Losses of IDR 6.7 Million in the Samota MXGP Circuit Corruption Case

JAKARTA - The West Nusa Tenggara High Prosecutor's Office (Kejati NTB) received the return of state losses in the case worth Rp6.7 billion from the former Regent of East Lombok Moch. Ali Bin Dachlan (Ali BD).

This return is related to the alleged corruption case for the purchase of land measuring 70 hectares by the Sumbawa Regency Government for the construction of the MXGP Circuit in the Samota area in 2022-2023 worth Rp. 6.7 billion. Ali BD is known as the owner and seller who received the payment for the land for the circuit project.

"Today, the NTB Prosecutor's Office received a return of state losses of IDR 6.7 billion from Ali BD," he said in a press conference in Mataram, Monday, quoted by Antara.

With the return of the overall loss of state finances that emerged from the results of the audit of the NTB Representative's Financial and Development Supervisory Agency (BPKP), the prosecutor followed up by designating the status of Rp6.7 billion as confiscated goods at the investigation stage.

"This confiscated money will then be deposited in the NTB Prosecutor's Office's shelter account at the Bank Mandiri Mataram Branch," he said.

Previously, the prosecutor's office stated that the state's financial losses in this case arose from the difference in the results of the appraisal team from the Public Appraisal Service Office (KJPP).

The Prosecutor's Office explained that the results of the first appraisal, the value of land measuring 70 hectares located in the Samota tourist area, Sumbawa Regency, belonged to the former Regent of East Lombok, amounted to Rp. 44.8 billion.

Then, the second appraisal result appeared for the follow-up of the appeal decision from a civil lawsuit that won a person named Sangka Suci for the claim of ownership of a portion of Ali BD's land. The second appraisal result also appeared with a value of Rp52 billion.

The civil judgment continued to the cassation level at the Supreme Court which stated that Sangka Suci's claim for part of the land was not proven.

Despite the ruling which has become legally binding or Inkrah, the Sumbawa Regency Government still executed the payment of 70 hectares of land to Ali BD with a value of Rp. 52 billion according to the results of the second appraisal.

In handling this case, the prosecutor's office on Thursday (8/1) arrested and detained two suspects, namely Subhan alias SBHN and Muhammad Julkarnaen alias MJ.

The Prosecutor's Office said that Subhan, who is currently serving as the Head of BPN Central Lombok, played a role as the head of land procurement when he held the position of Head of BPN Sumbawa. Meanwhile, Muhammad Julkarnaen as the assessment team from the private sector who came from KJPP.

In the determination of suspects based on the results of the case, the prosecutor determined the two by applying the punishment in accordance with the new Criminal Code regarding corruption.

The criminal is listed in Article 603 and/or Article 604 in conjunction with Article 20 letter c of Law Number 1 of 2023 concerning the Criminal Code.
