No Way Police Superpower, Here's How the New KUHAP Controls the Apparatus

JAKARTA - Deputy Minister of Law Edward Omar Sharif Hiariej considers that the police can be strictly controlled with the new KUHAP, namely Law Number 20 of 2025 concerning the Code of Criminal Procedure.

"It appears in the media that the police are superpowers, the police cannot be controlled, who said the police cannot be controlled? With this new KUHAP, the control is very tight," said Eddy's man, quoted by Antara, Tuesday, January 6.

Eddy explained that the strict control was reflected in the coordination relationship between investigators and public prosecutors.

"If with the old KUHAP, it could happen to be hostage to the case. The case can go back and forth, back and forth, but not back and forth. There is no legal certainty. If now it can't, no way, there must be legal certainty," he said.

According to him, this can happen because the period of handling cases is strictly regulated in the Criminal Procedure Code, namely regarding the coordination relationship between investigators and public prosecutors.

"If in the past there was a dangdut song, you started it, you ended it. If not now, the police start, the prosecutor ends," he said.

Therefore, he again emphasized that there would be no cases that would be suspended because the police had been strictly controlled in the new KUHAP.

"Once again, there will never be a case that is suspended because there is a coordination relationship between investigators and public prosecutors, and it is detailed in seven articles. So, the police are strictly controlled by the public prosecutor," he said.

Previously, the KUHAP Law was signed by Prabowo Subianto as the President of the Republic of Indonesia, and promulgated by Prasetyo Hadi as the Minister of State Secretary, namely on December 17, 2025.

Based on Article 369 of the KUHP, the regulation has been in force since January 2, 2026.
