JAKARTA - The Central Jakarta District Court (PN Jakpus) confirmed that the status of Vice President Gibran Rakabuming Raka cannot be sued through a civil mechanism, but can only be questioned through the impeachment process or impeachment by the People's Consultative Assembly (MPR).
PN Jakarta Pusat Spokesperson Sunoto said the constitution has clearly regulated the mechanism for dismissing the president and vice president who have been inaugurated.
"Regarding the status of the vice president, based on Articles 7A and 7B of the 1945 Constitution, the vice president who has been inaugurated can only be questioned through the impeachment mechanism by the MPR, not through a civil lawsuit," said Sunoto in Jakarta, Monday, December 22.
Sunoto explained that the civil lawsuit filed by Subhan against Gibran Rakabuming Raka and the General Election Commission (KPU) of the Republic of Indonesia could not be continued because the Central Jakarta PN did not have the authority to try the case.
According to him, the main lawsuit filed by the plaintiff basically questions the KPU's decision. Meanwhile, the KPU decision is the object of a dispute over state business.
"The substance of the lawsuit questions the decision of the KPU which is a state business decision. Based on Article 47 of Law Number 51 of 2009, the authority to prosecute is with the State Business Court," said Sunoto.
With these considerations, the panel of judges decided that the case would stop at the interim ruling stage and not continue to the proof stage.
"When the ruling states that the District Court is not authorized, it is already a final decision that ends the case. Of course, those who are not satisfied can still take legal action in accordance with the provisions," he said.
The case with number 583/Pdt.G/2025/PN Jkt.Pst has been registered since August 29, 2025. In his lawsuit, Subhan assessed that Gibran and the KPU RI had committed acts against the law regarding the requirements for the vice presidential candidacy.
The plaintiff questioned Gibran's educational history, which was recorded as having attended Orchid Park Secondary School, Singapore, in 2002-2004, and UTS Insearch Sydney in 2004-2007. According to Subhan, both institutions do not meet the requirements as an educational institution equivalent to high school as required by law.
On this basis, the plaintiff asked the panel of judges to declare that Gibran and the KPU had committed an act against the law, declared Gibran's status as vice president invalid, and sentenced the defendants to pay compensation.
In his petition, Subhan demanded material and immaterial compensation of IDR 125 trillion and IDR 10 million to be deposited into the state treasury.
