Deputy Minister Of Law And Human Rights Calls The Bill On Criminal Adjustments To Change Confinement Crimes To Fines

Deputy Minister of Law (Wamenkum) Eddy Hiariej revealed that the Draft Law (RUU) on Criminal Adjustments regulates that imprisonment is adjusted or converted into a criminal fine.

He explained that this was adjusted because the new Criminal Code (KUHP) no longer recognizes imprisonment. For this reason, tens of thousands of regional regulations that have imprisonment are converted to criminal fines.

"With the provision that if the Regional Regulation is sentenced to a single imprisonment, it will be converted into a fine," said Eddy during a working committee meeting with Commission III of the DPR RI at the Parliament Complex, Jakarta, Antara, Wednesday, November 26.

In addition, he said that if the sentence was a single fine, then a single fine would be changed based on legal subjects. The bill, according to him, also regulates the category for fines in accordance with the new Criminal Code.

"If the perpetrators are individual, then there are at most Category II, which means 10 million. But if the perpetrators are corporate, it will be changed to at most Category V. Category V is around 500 million," he said.

In addition, the category of fines can also be imposed based on financial benefits. If the sentence is committed individually, the category is lower than the crime committed by the corporation.

Then, he said that if the criminal fine is jointly with imprisonment, it means that it is a cumulative crime. For this reason, the imprisonment is removed and the fine is adjusted based on the provisions of the single fine.

For imprisonment, he said that if the prison sentence together with the criminal fine, then the conversion requirement is that the cumulative sentence is changed to an alternative cumulative.

Currently, he said, many laws outside the Criminal Code always give imprisonment and criminal fines. This, he said, would be changed in the Criminal Adjustment Bill to "a prison sentence and/or a fine".

"So giving freedom to judges. But we don't need to worry, because in the new Criminal Code there are punishment guidelines," he said.
