JAKARTA - Member of Commission III of the DPR, Gilang Dhielafararez reminded that detrimental actions for BUMN officials can now be charged by the Corruption Eradication Commission (KPK). This is because the State-Owned Enterprises Law (UU BUMN) which was recently passed in the DPR has placed BUMN officials as part of state administrators.

According to Gilang, this rule is a strategic step in strengthening the integrity and eradication of corruption. Where the status of a BUMN official is no longer in a grey area' but is included in a clear legal regime like other public officials.

"This means that any action of them that smells of fraud or harm to state finances can be directly charged by law enforcement officials, including the Corruption Eradication Commission (KPK)," Gilang told reporters, Wednesday, October 8.

To note, the KPK is now gaining flexibility and legal certainty in investigating corruption within the State-Owned Enterprises (BUMN) after the revision of the BUMN Law was passed into law some time ago.

One of the points in the BUMN Law governing the abolition of the provisions of members of the board of directors, members of the board of commissioners and supervisors is not a state administrator. As a result of this new regulation, these officials must make a State Administrators Wealth Report (LHKPN).

According to Gilang, the regulation strengthens supervision of SOE directors, especially from actions that harm state finances. "With this new regulation, the KPK's authority in supervising, coordinating, and taking action against corruption in SOEs is now increasingly relevant," he said.

Nevertheless, Gilang reminded the Government to ensure that derivative regulations and governance in BUMN are in line with the spirit of transparency. This, according to him, so that changes to the rules in the BUMN Law do not provide space for legal loopholes that can be used to protect corrupt practices.

"And with the extension of the mandate of the Supreme Audit Agency (BPK) to conduct a regular audit of SOEs, the results of the audit must be able to be an entry point for law enforcement," explained the legislator from the Central Java II electoral district.

Gilang also emphasized the importance of synergy between the BPK, KPK, the Attorney General's Office, and the National Police to ensure that every alleged fraud in BUMN is followed up quickly and professionally. "BUMN manages state assets in a very large amount, so that any potential abuse has direct implications for people's welfare," said Gilang.

He also ensured that Commission III of the DPR would oversee the implementation of the revision of the BUMN Law, both through the legislative and supervisory functions, so that it would truly become an effective law enforcement instrument.

"In the end, the main goal is not only to prevent state losses, but also to ensure that SOEs are present as strategic instruments for development that are free from corrupt practices and really serve the interests of the people," concluded Gilang.
