Hope The Criminal Code Bill Is Ratified, Deputy Minister Of Law And Human Rights Eddy: All Prisoners In The Police-The Prosecutor's Office Can Be Released

Deputy Minister of Law (Wamenkum) Eddy Hiariej urged that the Draft Law on the Criminal Procedure Code (KUHAP) be ratified immediately if it does not want to have legal implications, namely that all prisoners can be released.

He said that the suspects detained by the police and the prosecutor's office are currently using the old Criminal Procedure Code which refers to the old Criminal Code (KUHP) as well. Meanwhile, the Criminal Code will only take effect in January 2026.

"If the Criminal Procedure Code is not ratified, I will give just one example of implications, all detainees in the police and prosecutors can be released," said Eddy during a meeting to discuss the National Legislation Program (Prolegnas) held by the Legislation Body of the DPR RI at the parliament complex, Jakarta, Thursday, which was confiscated by Antara.

So, Eddy said that if the Criminal Procedure Code Bill was not passed this year, law enforcement officials would lose legitimacy in carrying out forced efforts. This will be a record for the government.

Meanwhile, Chairman of the Legislation Body of the DPR RI Bob Hasan said that the Criminal Procedure Code is targeted by the DPR to be completed this year. However, Commission III of the DPR RI also received demands from the public to discuss the Asset Confiscation Bill.

"On the basis of public demands today, we must complete the Asset Confiscation, so we will include Asset Confiscation in 2025," said Bob.

The Criminal Procedure Code Bill is a bill that is included in the 2025 Priority Prolegnas discussed by Commission III of the DPR RI. Currently, the discussion is almost complete because it has finished discussing the problem inventory list in the bill.

However, Commission III of the DPR RI is also still absorbing public aspirations related to the bill from various regions so that the Criminal Procedure Code Bill has not yet been approved to move up to the next stage, namely the plenary meeting.
