ASN In Aceh Imprisoned For 199 Months For Rape Of Stepdaughter, Now Temporarily Dismissed

SUKA MAKMUE - The Nagan Raya Regency Government, Aceh, temporarily suspended a state civil servant (ASN) with the initials HS, after being declared a convict in a rape case against two of his stepchildren.

The decision to dismiss was made following the verdict of the Syar'iyah Suka Makmue Court on Wednesday, July 24, 2025, which sentenced HS to 199 months in prison.

"For now, the person concerned has been temporarily dismissed from ASN, is still waiting for the ongoing legal process," said Head of the Nagan Raya Regency Personnel and Human Resources Development Agency (BKPSDM), Zulfikar Irhas, to ANTARA, Thursday, August 7.

Zulfikar explained that HS was still filing an appeal. However, the status as a convict requires local governments to apply the rules of staffing discipline in accordance with applicable regulations.

The temporary dismissal of HS refers to Government Regulation Number 94 of 2021 concerning Civil Servant Discipline. With this status, HS is only entitled to receive 50 percent of the basic salary he usually receives.

"After being temporarily dismissed, HS only received a 50 percent salary of the total received," said Zulfikar.

He added that further decisions would be taken after the legal process reached a decision with permanent legal force. The local government is said to be still waiting for the results of the appeal submitted by HS.

Zulfikar also appealed to all ASN and government employees with work agreements (PPPK) within the Nagan Raya Regency Government to maintain integrity and morality, and be role models in society.

Previously, in the verdict, the Panel of Judges of the Syar'iyah Court Suka Makmue, chaired by Zulfikri, stated that HS was legally and convincingly proven to have committed rape of children. The act was declared in violation of Article 50 of Aceh Qanun Number 6 of 2014 concerning Jinayat Law.

HS was sentenced to 199 months in prison. The judge also decided that the prison terms that had been served would be reduced entirely from punishment.

In addition to corporal punishment, the judge determined that a number of pieces of evidence were returned to the agency where the defendant worked. Among them are black Honda Mega Pro motorcycles with police numbers BL-2015-AM, complete with frames, machines, and keys. HS is also charged with paying court fees of Rp. 3,000.
