Banding Study Money Of IDR 1.1 Billion Corrupted, Aceh Bireuen Sub-district Head Threatened To Buy

BANDA ACEH - The Public Prosecutor (JPU) of the Bireuen District Attorney, Aceh Province, charged a sub-district head in Bireuen Regency with committing a criminal act of corruption in the study funds against a number of village heads to East Java and Bali with a budget of Rp1.1 billion.

The indictment was read out by Public Prosecutors Siara Nedy and Muhammad Furqan Ismi during a trial with the panel of judges chaired by Irwandi and accompanied by Heri Alfian and M Arief Hamdani, each as member judges at the Corruption Court at the Banda Aceh District Court in Banda Aceh, Friday.

The defendant Teguh Mandiri Putra as the Head of Peusangan Sub-district, Bireuen Regency, was present at the trial accompanied by his team of legal advisors.

In his indictment, Public Prosecutor Siara Nedy said the defendant carried out an comparative study which was attended by 63 village heads and village assistance to Ketapantrame Village and Wonorejo Village in East Java Province and Panglipuran Village in Bali Province, at the end of May 2024.

The comparative study, he said, was only based on the village deliberation.

The budget for the comparative study came from village funds with a value of more than Rp. 1.1 billion. Each village is charged with paying comparative study funds of Rp. 17.8 million.

"The appeal study activity was carried out without a task order signed by the Regent of Bireuen. The assignment warrant was only signed by the defendant, always the sub-district head. Based on the rules, the regional out-of-regional appeal study must be signed by the regent," said the prosecutor as quoted by ANTARA, Friday, July 18.

In addition, said the Public Prosecutor, the comparative study was without any planned activities and budget plans. The implementation of the appeal study involves third parties without going through the mechanism for procuring goods and services.

The Public Prosecutor stated that the appeal study carried out by the defendant violated the Regulation of the Minister of Home Affairs of the Republic of Indonesia Number 96 of 2017 concerning the procedures for village cooperation in the field of village government, as well as the Regulation of the Minister of Villages, Development of Disadvantaged Regions, and Transmigration of the Republic of Indonesia Number 7 of 2023 concerning the priority details of the use of village funds.

In addition, the Bireuen Regent Regulation Number 55 of 2023 concerning guidelines for the preparation of the gampong budget for the 2024 fiscal year, as well as the Qanun of Bireuen Regency Number 6 of 2018 concerning the gampong government.

Based on the results of an audit by the Aceh Representative Financial and Development Supervisory Agency (BPKP), said the prosecutor, the state losses he caused in the comparative study activities reached Rp. 383.29 million.

The prosecutor charged the defendant with the primary charge of violating Article 2 Paragraph (1) in conjunction with Article 18 Paragraph (1) letters a, b, Paragraph (2) and Paragraph (3) of Law Number 31 of 1999 as amended into Law Number 20 of 2001 concerning the eradication of criminal acts of corruption in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code.

As well as subsidies violating Article 3 in conjunction with Article 18 Paragraph (1) letters a, b, Paragraph (2) and Paragraph (3) of Law Number 31 of 1999 as amended into Law Number 20 of 2001 concerning the eradication of criminal acts of corruption in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code.

The defendant and his legal adviser stated that they did not object to the indictment of the public prosecutor. The defendant and his legal adviser also stated that they did not file an exception.

The panel of judges continued the trial with the agenda of examining witnesses on Wednesday (23/7). The panel of judges ordered the public prosecutor to present witnesses at the next trial.
