Children Owners Of A Bakery Shop Who Persecuted Employees Sentenced To 10 Months In Prison

JAKARTA - The East Jakarta District Court (Jaktim) handed down a sentence of 10 months in prison to the son of a bakery owner namedten Sugama Halim who abused his female employee.

In its decision, the East Jakarta District Court Panel of Judges found George guilty of molesting female employee Dwi Ayu Darmawati on October 17, 2024.

"The sentence is 10 months, reduced from the arrest period and detention period that the defendant has served," said Chief Judge Heru Kuntjoro at the East Jakarta District Court, Thursday, May 8, as reported by ANTARA.

Heru said that based on the facts of the trial, George violated Article 351 paragraph 1 of the Criminal Code concerning persecution as demanded by the Public Prosecutor (JPU).

The decision of the East Jakarta District Court Panel of Judges is lighter than the demands of the East Jakarta District Prosecutor's Office who asked George to be sentenced to one year in prison.

The panel of judges stated that there were mitigating and burdensome things that were taken into consideration when passing a verdict for George. The aggravating situation of the defendant's actions was damaging people's welfare

"Meanwhile, the situation that relieves the defendant is that he has never been convicted and the defendant regrets his actions," said Heru.

In addition, the consideration of mitigating the sentence against George is almost similar to mitigating considerations when the East Jakarta District Attorney's Public Prosecutor filed a lawsuit.

The difference is that the East Jakarta District Court Panel of Judges did not make George's medical condition, which the Public Prosecutor said suffered from mild disabilities as a matter of easing his sentence.

In addition, the East Jakarta District Court Panel of Judges also rejected the defense note (pleidoi) of the defendant's legal adviser who asked that George be rehabilitated at a medical facility due to his mental condition.

According to the panel of judges, George was still able to work to help manage the bakery business of his parents, so that his mental condition did not invalidate the acts of abuse committed.

"Considering that the defendant can still work even within the family sphere, he can still order online and can communicate well in court," explained Heru.
