KPK Detains 3 Former Directors Of PT ASDP Suspects Of Corruption In PT Jembatan Nusantara Business-Acuation Cooperation

JAKARTA - The Corruption Eradication Commission (KPK) detained three former directors of PT ASDP Indonesia Ferry (Persero). They are suspected of harming state finances when carrying out business cooperation (KSU) and the acquisition of PT Jembatan Nusantara.

"KPK is making forced efforts in the form of detention of three former Board of Directors of PT ASDP," said Acting Director of KPK Investigation Budi Sokmo at the KPK's Merah Putih building, Kuningan Persada, South Jakarta, Wednesday, February 13.

Those detained were former President Director of PT ASDP Indonesia Ferry (Persero), Ira Puspadewi; Harry MAC as former Director of Planning and Development; and Muhammad Yusuf Hadi as former Commercial and Service Director of PT ASDP Indonesia Ferry (Persero). Budi said the detention was carried out for the first 20 days and could be extended.

The three former directors are suspected of having harmed the state by Rp.893,160,000,000 because of the business cooperation and acquisitions carried out. This is because the process is not in accordance with the rules.

Budi revealed that this case began when Ira took office in 2018. At that time, Adjie as the owner of PT Jembatan Nusantara offered his company for acquisition.

This process has actually been carried out since 2014 but was rejected. Then, Adjie again offered his company to Ira et al when he was a director.

This offer, continued Budi, was carried out by Adjie through informal channels, namely by holding meetings in a number of places by inviting Ira, Harry, and Yusuf Hadi. Then in 2019, Adjie offered his company in writing to PT ASDP Indonesia Ferry (Persero).

"Then followed up by PT ASDP Indonesia Ferry (Persero) by conducting business cooperation with PT Jembatan Nusantara in 2019-2020 and further extended from 2021-2022," said Budi.

In the middle of this process, Ira then submitted a letter to the commissioner of PT ASDP Indonesia Ferry (Persero) who asked for permission for business cooperation with PT Jembatan Nusantara. However, the letter is actually different from his request to the Minister of SOEs.

To the Minister of SOEs, Ira actually said that she was conducting an assessment with PT Jembatan Nusantara to carry out an acquisition and explain business cooperation as a start. In fact, at that time the board of commissioners did not agree on Ira's intentions and other directors.

In addition, PT ASDP Indonesia Ferry actually does not have internal guidelines for the implementation of the acquisition. "So IP ordered the team to draft the board of directors' decisions," said Budi.

After the process progressed, the acquisition was finally agreed upon with a value of Rp1,272 trillion on October 20, 2021. This agreement was taken after several meetings, said Budi.

Budi detailed Rp892 billion for the value of shares including 42 ships belonging to PT Jembatan Nusantara and Rp380 billion for the value of 11 ships belonging to the affiliate of PT JN and the new management of the private company.

"On the calculations carried out, the acquisition transaction of PT JN by PT ASDP is indicated to cause state financial losses of at least Rp. 893,160,000,000," he explained.

As a result of his actions, these three suspects are suspected of violating Article 2 paragraph (1) or Article 3 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption, as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes Jo. Article 55 paragraph (1) 1st of the Criminal Code.
