PKWT Dispute Session, Former Pegadaian Employee, Witness Calls Job Plaintiff Until Retirement

The Central Jakarta District Court has again held a trial for a civil lawsuit regarding the Certain Time Work Agreement (PKWT) for Pegadaian employees.

JAKARTA - The Central Jakarta District Court has again held a trial for a civil lawsuit regarding the Pegadaian employees' Specific Time Work Agreement (PKWT).

During the trial, the two witnesses who were presented strengthened the plaintiff's argument regarding having worked at the state-owned company.

The two witnesses are the union management of PT Pegadaian Persero, namely Satoto and Ketut Suhardiono.

In his testimony, Satoto knew that the plaintiff, Marshal Aritonang, had worked at PT Pegadaian and retired in 2023. In addition, before entering retirement, the plaintiff proposed an extension of the work period in accordance with the provisions.

This is because Marshal has met the criteria or basic requirements as a retired employee to continue working relationships with the PKWT contract.

"Employees who enter retirement can apply for PKWT with the condition that they are healthy, have good behavior, and have a good work assessment." said Satoto, Wednesday, February 12.

Even with witness Ketut Suhardiono who is an ex. It is said that Marshal's performance is quite good and can even be said to be above average. So that it meets the submission requirements.

"The person concerned is included in the performance site category and also has a health certificate," he said.

Selain itu, Ketut juga menyampaikan perkara gugatan perjuangan soal PKWT pensiunan di perusahaan pelat merah tersebut untuk pertama kali terjadi di mejau. Sebab sebelumnya, kasus serupa ada 12 orang yang mendapat kesempatan untuk melanjutkan sebagai pekerja dengan waktu tertentu.

"Even though it was only 3 months and an extension of 1 month," he said.

For information, Marshall Aritonang sued PT Pegadaian after the company refused to extend its work contract after entering retirement age. Even though Marshall has the good performance and competence that is still needed.

Marshall's contract extension application in October 2023 was rejected by PT Pegadaian. The reason is because the results of the health examination show Marshal is deemed unfit to work for a while.

Meanwhile, based on the Collective Work Agreement (PKB) for the period 2023-2025, employees who have retired can continue working relationships with PKWT contracts for two years, as long as they meet a number of requirements including physical health.
