Constitutional Court Decision: 40 Cases Of Pilkada Dispute Continued Evidence, 270 Run Aground

JAKARTA - The Constitutional Court has submitted a decision on whether or not the case of dispute over the results of the regional head election (PHPU Kada) on Tuesday and Wednesday which resulted in 40 cases continuing to the stage of the evidentiary trial and 270 other cases ran aground.

A total of 270 cases that ended in aground consisted of 227 cases decided unacceptable, 29 cases were decided to be withdrawn, eight cases were declared dead, and six cases were determined not under the authority of the Court.

The verdict cannot be accepted because the applicant or his petition does not meet the formal requirements. Most of the cases that cannot be accepted are because the applicant does not have the legal position to apply.

Amar's decision to withdraw is a follow-up to the petition for withdrawal submitted by the applicant on the previous occasion. Meanwhile, the stipulation was determined to fall because both the applicant and his attorney were not present at the inaugural trial for no valid reason.

Meanwhile, the ruling was not authorized because the petitioner's petition was not under the authority of the Constitutional Court. Supposedly, the object disputed was the KPU's decision regarding the election results, but the applicants of them actually sued the minutes.

Furthermore, a total of 40 cases are still in dispute at the Constitutional Court and will be tried in the evidentiary stage consisting of three cases of governor dispute, three cases of mayorial dispute, and 34 cases of regent dispute.

The trial for the evidentiary stage is scheduled for February 7, 2025. All the continuing cases will be decided on February 24, 2025. The following is a complete list of cases of the 2024 Pilkada dispute that are still rolling in the Constitutional Court:
