PDIP Secretary General Hasto Kristiyanto will fulfill the KPK's summons on Monday, January 13, as a form of respect for citizens for the ongoing legal process. However, his party considered that respect for the law was also the responsibility of the KPK as a law enforcement agency.

"We invite the KPK to comply with the law, one of which is in the form of respecting and complying with the court's decision regarding the Wahyu Setiawan case which has been decided, starting from the District Court Decision, appeals to Cassation," said Hasto Kristiyanto's Legal Advisor, Patramijaya, in his statement, Saturday, January 11.

Patra assessed that there were points that the KPK should have obeyed in the facts of the trial and the considerations of the panel of judges at Decision No.28/Pid.Sus-Tpk/2020/PN.Jkt.Pst with Defendants Wahyu Setiawan and Agustiani Tio Fridelina.

First, Harun Masiku has agreed to prepare Rp1, 5 billion for operational costs for management at the KPU and provide it in two stages. Second, in the decision on page 161, it was stated that the first and second phase operational funds came from Harun Masiku.

This was confirmed in the Supreme Court Decision No. 1857 K/Pid.Sus/2021 with the defendants Wahyu Setiawan and Agustiani Tio Fridelina, which read "a. The Cassation Panel of Judges at the Supreme Court stated that the PN and PT Decisions had properly and correctly considered legal facts; "Judex Facti did not wrongly apply the law in judging the Defendants, Judex Facti has considered the legal facts revealed before the trial correctly and correctly and did not exceed his authority".

"b Wahyu Setiawan asked for operational costs so that Harun Masiku's desire to become a member of the DPR-RI in the amount of Rp1,000,000,000,- (one billion rupiah); Defendant I has taken advantage of his strategic position as a member of the General Election Commission (KPU) and played an active role through Defendant II who negotiated with Saeful Bahri to take care of Harun Masiku's interests so that Harun Masiku could replace Rezky Aprilia as a member of the House of Representatives (DPR) in the Interimal Replacement (PAW) of the Indonesian Democratic Party of Struggle (PDIP), and asked for operational costs of Rp1,000,000,000.00 (one billion rupiah) so that Harun Masiku's wishes conveyed through Saeful Bahri and Defendant II can be granted".

"c. Wahyu Setiawan received Rp200,000,000 in cash, - (two hundred million rupiah), namely: "Defendant I through Defendant II received a down payment of Rp200,000,000.00 (two hundred million rupiah) and then in a meeting with Saeful Bahri at Pejaten Village Mall in order to discuss Harun Masiku's interests, Saeful Bahri gave Defendant II a sum of SGD of 19,000.00 (nine thousand Singapore dollars) which then Defendant I took a total of SGD 15,000.00 (fifteen thousand Singapore Dollars) and was given as part of Defendant II for a total of SGD 4,000.00 (four thousand Singapore Dollars), besides that Defendant II also received Rp50,000,000.00 (fifty million rupiah) from Saeful Bahri through Donfri which was used for the personal interests of Defendant II".

"d. Wahyu Setiawan and Agustiani Tio Fridelina were quoted by the KPK with the findings of SGD 38,000,- (equivalent to Rp400,000,000).

Defendant I and Defendant II were secured by members of the Corruption Eradication Commission (KPK) together with evidence in the form of money in the amount of SGD 38,000.00 (twenty-eight thousand Singapore dollars) which was originally to be handed over by Defendant II to Defendant I".

Thus, the total funds that Harun Masiku has given are Rp1.25 billion from the total commitment of Rp1.5 billion.

"Based on the judge's consideration in the decision with the defendant Wahyu Setiawan & Agustiani Tio, it should have been understood that all the sources of funds given to Wahyu Setiawan for the management of Harun Masiku's election came from Harun Masiku," said Patra.

Patra emphasized that there was not a single part of the panel of judges' considerations, from the District Court to the Supreme Court, which stated that the source of Harun Masiku's bribe funds was from Hasto Kristiyanto.

"According to all parties, especially the KPK as law enforcers respects and guided the decision. Even if there is a new fact that is most likely to happen, it is if Harun Masiku is found and provides information. Therefore, the KPK should not have premature named our client as a suspect," said Patra.
