JAKARTA - Director of PT Stanindo Inti Perkasa (SIP) MB Gunawan was sentenced to 8 years in prison in connection with the alleged corruption case in the management of tin commodity trading in the mining business permit (IUP) area of PT Timah in 2015 2022.

The Public Prosecutor (JPU) of the Attorney General's Office, Ardito Muwardi, has demanded that the panel of judges declare that MB Gunawan has been legally and convincingly proven guilty of committing a criminal act of corruption together.

"The defendant violated Article 2 Paragraph (1) in conjunction with Article 18 of Law (UU) Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 in conjunction with 55 Paragraph (1) of the 1st Criminal Code, as in the primary indictment of the public prosecutor," said the Public Prosecutor in a hearing reading the charges at the Jakarta Corruption Court reported by ANTARA, Thursday, December 5.

In addition to imprisonment, MB Gunawan was also charged with a fine of Rp. 750 million, subsidiary to six months in prison.

In filing charges against MB Gunawan, the Public Prosecutor considered several aggravating and mitigating matters.

This is burdensome, namely the actions of MB Gunawan not supporting government programs in the context of organizing a clean and free country from corruption, collusion, and nepotism.

Then, MB Gunawan's actions were considered to have resulted in state financial losses and massive environmental damage.

"Meanwhile, the mitigating factors considered are that the defendant has never been convicted before," the prosecutor added.

Meanwhile, MB Gunawan was previously charged with buying tin ore from illegal mining in the PT Timah Tbk Mining Business License (IUP) area, causing a loss to the state of Rp. 300 trillion in the case of alleged tin corruption in 2015-2022.

The activity was allegedly carried out by MB Gunawan alone and together with the Beneficiary Owner of PT SIP Suwito Gunawan alias Awi through PT SIP and its affiliated companies, namely CV Bangka Jaya Abadi and CV Rajawali Total Persada.

Actions were also carried out along with other private smelters, including PT Refined Bangka Tin (RBT), PT Sarijuna Binasentosa (SBS), CV Venus Inti Perkasa (VIP), and PT Tinindo Inter Nusa (TIN).

In the indictment, it was stated that PT SIP and its affiliated companies did not fully carry out mining in their respective IUP areas, but instead bought tin ore from the mining of illegal collectors or miners based on the volume of kilograms per tin level through MB Gunawan.
