KPK Objects To Follow Up On Ombudsman Findings Related To TWK Maladministration Allegations

JAKARTA - The Corruption Eradication Commission (KPK) objected to following up on findings and corrective actions that had been announced by the Indonesian Ombudsman regarding the alleged maladministration of the implementation of the National Insight Test Assessment (TWK).

This objection was conveyed by the Deputy Chairperson of the KPK, Nurul Ghufron at a press conference held at the KPK's Red and White building, Kuningan Persada, South Jakarta.

"The complainant expressed his objection to following up on corrective actions suggested by the Indonesian Ombudsman to the KPK," said Ghufron on the Indonesian KPK YouTube, Thursday, August 5.

The KPK considers the Indonesian Ombudsman to be unfair in their findings and is considered to have disrespected his authority as the executor of the TWK. In addition, Ghufron said the Ombudsman had given an offensive statement.

According to him, the implementation of TWK has been carried out in accordance with applicable regulations. Ghufron also emphasized that there was no maladministration whatsoever in the implementation of the test.

The KPK also accused the Indonesian Ombudsman of feeling more powerful than the laws and regulations in force in Indonesia. This is evidenced by the attitude of the Ombudsman who did not delay the examination of alleged violations in the TWK process.

In fact, at the same time the judicial review related to TWK is being carried out at the Supreme Court and the Constitutional Court. "The Ombudsman must refuse even though the inspection must be stopped (during the material test, ed)," said Ghufron.

He also emphasized that the Ombudsman cannot interfere with the KPK's attitude in releasing employees who fail in the TWK because this is an internal matter. Ghufron said that the State Administrative Court (PTUN) was not supposed to solve this problem, not the Ombudsman.

Ghufron also denied any infiltration of articles on the implementation of TWK as found by the Ombudsman. According to him, all proposals related to the test as a condition for the transfer of employee status are always conveyed openly.

On this occasion, the KPK also defended the State Civil Service Agency (BKN) which was called incompetent in the implementation of TWK. Ghufron said this finding does not make sense because BKN is an institution that screens the acceptance of state civil servants (ASN) in Indonesia.

"Who else can the KPK ask TWK if BKN refuses? This is not logical!" he said.

Finally, the KPK also denied not following President Joko Widodo's (Jokowi) directions regarding TWK. According to Ghufron, the joint meeting held on May 25 was a follow-up to Jokowi's directives.

"We will submit this objection letter as soon as possible tomorrow, August 6 morning to the Ombudsman," he concluded.
