Tessa Kaunang Somasi Sandi Tumiwa After Posting Hoax Photo Wearing Hijab Without Permission

JAKARTA - New strife has enveloped the relationship between former husband and wife Tessa Kaunang and Sandi Tumiwa. This time, Tessa through her legal team sent an open summons after Sandi uploaded an edited photo of Tessa wearing a hijab without permission on social media.

"We want to clarify the post on Sandi Tumiwa's Instagram account which is considered disturbing and not in accordance with the original. We can confirm that it was posted without permission, without rights, and edited without permission," said Sunan Kalijaga in South Jakarta, Tuesday, June 9.

This legal step was taken because Sandi's actions were not just a whim, but had entered the realm of serious legal violations. Agustinus Nahak, one of Tessa's legal teams, revealed four laws that Sandi allegedly violated.

"Editing photos or videos of others without valid permission is an act prohibited by law. This act can be charged with four laws; Criminal Code, ITE Law, Data Protection Law, and Copyright Law," said Agustinus Nahak.

No kidding, the legal consequences awaiting Sandi Tumiwa are quite heavy. In addition to the body's punishment, there is a material fine with a very fantastic value if this case continues to the green table.

"The threat of the sentence varies, it can be light and can also be heavy, reaching a threat of 12 years in prison and a fine of billions of rupiah. This is clearly a violation of criminal law," continued Agustinus.

Tessa's party emphasized that even if the photo used is an original photo, displaying the face of another person without consent can still be prosecuted, especially if the photo has been visually manipulated.

"Even if it is an original photo, if someone who is displayed in the photo does not like it, it is also clear that it violates the law. Moreover, here it is clear that the photo has been changed, edited, not original, and posted without permission," added Sunan Kalijaga.

Therefore, the legal team gave a stern warning to Sandi Tumiwa to immediately delete the content from all of his social media platforms within a short time.

"We ask that within 3 times 24 hours the edited photos without rights and disseminated on Instagram and TikTok media be immediately taken down. If he doesn't take it down, there will definitely be other legal efforts we take," said Agustinus again.
