Jampidum Disbursed New Instruments Of The Criminal Code: Social Work Crimes As A Last Effort
JAKARTA - Deputy Attorney General for General Crimes (Jampidum) Asep Nana Mulyana said that social work criminal sanctions will become one of the new instruments in the application of Law (UU) Number 1 of 2023 concerning the National Criminal Code (KUHP).
"So, the National Criminal Code will bring fundamental changes. Prisons, in the future, will no longer be the main instrument, but will be the ultimum remedium or last resort," he said after witnessing the signing of the Memorandum of Understanding (MoU) or a memorandum of understanding on the Implementation of Social Work Crimes for Criminal Actors at the NTB Governor's Hall, Mataram, Wednesday, was confiscated by Antara.
Asep Nana explained that the application of criminal sanctions for social work is part of a criminal alternative in addition to imposing fines, supervision, and conditional crimes. Everything will be adjusted to the needs of the region and the ability of the convict.
"Later we will see if the perpetrator has the capacity, has the convenience of certain expertise and so on. It will be adjusted," he said.
He added that the application of criminal sanctions for social work is not always in the form of physical work such as cleaning the environment or public facilities.
"The alternative sanctions are not solely cleaning the road. Not only cleaning the sewers. But also other forms according to regional needs. The principle is benefit for the community and capacity building," he said.
However, he emphasized that not all types of cases can be applied criminal sanctions for social work, one of which is a corruption case.
"So Law Number 1 of 2023 now provides restrictions, corruption cases do not need social work. So corruption cases are not included in this environment," said Asep Nana.

For the status of child convicts, the application of criminal sanctions for social work can also be applied. However, it is more of a more educational and rehabilitative approach.
"For children, social work does not have to be physical. It can be in the form of training, coaching, or education according to the character and talent of children. The goal is that after serving a crime, children can return to society with better capacity," he said.
In this memorandum of understanding between the NTB Provincial Government and the NTB High Prosecutor's Office, Asep Nana Mulyana was present representing the Attorney General's Office together with the Head of the NTB Attorney General's Office Wahyudi and the head of state prosecutors in districts and cities in NTB. Also present was the Governor of NTB Lalu Muhamad Iqbal along with regents and mayors throughout NTB.
