Facing Demands For 11 Years In Prison, Attorney Nikita Mirzani Calls Prosecutors Inconsistent And Not Based On Facts

JAKARTA - Nikita Mirzani's legal team gave a strong response to the 11-year prison sentence filed by the Public Prosecutor (JPU) in the alleged defamation case and the Crime of Money Laundering (TPPU).

Usman Lawala, as a lawyer, stated that the charges were not based on the facts revealed at the trial and highlighted a number of inconsistencies in the prosecutor's argument.

"The lawsuit is no longer based on facts, no longer based on the evidence at trial," said Usman Lawala after a trial at the South Jakarta District Court, Thursday, October 9.

Usman highlighted the two main articles in the prosecution, namely Article 27B of the ITE Law and Article 3 of the Money Laundering Law. According to him, the prosecutor changed the core argument regarding the threat tool in the ITE case.

If in the initial indictment the threat is said to be an act of vilifying products, in the prosecutor's demands, the prosecutor actually mentions the tool that threatens it is evidence of the purchase of a disguised product.

"This means that the prosecutor himself is inconsistent with his indictment. At the beginning he mentioned the threat because he wanted to open his problematic product, now it has been changed in his demands," explained Usman.

Regarding the money laundering offense, Usman emphasized that his client had no malicious intent (mens rea) to hide or disguise the origins of assets

He explained that the transfer of money was the result of a clear business agreement with Reza Gladys. The funds were transferred to the account of the company PT Bumi Parawisessa on behalf of Nikita Mirzani, who according to him proved that there were no attempts to hide.

"How is the element of hiding or disguising fulfilled? The money was not rotated. The transfer was clear, the order was in the name of Nikita Mirzani," he said.

His party is currently preparing a comprehensive pledoi (defense note) to refute all points of prosecution's demands.
