Referring To The BUMN Law, Dony Oskaria Should Resign From COO Danantara And CEO Of DAM
JAKARTA - The appointment of Dony Oskaria as Head of the BUMN Regulatory Agency (BP BUMN) has received attention. The reason is, Dony is currently also serving as COO of Danantara Indonesia and CEO of PT Danantara Asset Management (Persero) (DAM).
BUMN observer and NEXT Indonesia Center Director, Herry Gunawan said Dony Oskaria should have resigned from this position after being appointed Head of BP BUMN.
Moreover, said Herry, referring to the Draft Law (RUU) on the Fourth Amendment to the BUMN Law, it also regulates the position of Head of BP BUMN as a member of the Danantara Supervisory Board.
This provision is contained in Article 3N Paragraph (1) letter c of the BUMN Bill (Fourth Amendment), which includes BP BUMN as a member of the Supervisory Board along with other ministries.
This article is an amendment to Law Number 19 of 2003 concerning SOEs, which was originally only called a 'ministerial ministry that organizes government affairs in the field of SOEs'.
According to the draft BUMN Law that I received, he should resign (from COO Danantara and CEO DAM). But he's ex-officio as the Danantara Supervisory Board," Herry told VOI, Thursday, October 9.
Herry explained that BP BUMN is carrying out its function as a regulator. Meanwhile, COO Danantara and CEO DAM act as operators. So, it must be separated so that there are no conflicts of interest in the management of SOEs.
With Dony's current position, Herry assesses that there is a potential for overlapping serious roles and conflicts of interest.
"It's funny, he (as the Head of BP BUMN) who makes regulations, he (as the Supervisory Board of the Danantara) supervises, he (as the Danantara COO and CEO of DAM) runs. This creates absolute power that has the potential for moral hazard, such as corruption. Conflict of interest is very clear there," said Herry.

Previously, President Prabowo Subianto inaugurated Dony Oskaria as Head of the State-Owned Enterprises (BP) Regulatory Agency (BUMN) at the State Palace, Jakarta, on Wednesday, October 8.
Dony's appointment is based on Presidential Decree (Keppres) Number 109/P of 2025 concerning the Appointment of the Head and Deputy Head of BP BUMN which was read by the Deputy for Apparatus Administration of the Ministry of State Secretariat, Nunik Purwanti.
Dony's inauguration was carried out in line with the change in the status of the Ministry of SOEs to the governing body. The change in status is in line with the inauguration of the Draft Law (RUU) concerning the Fourth Amendment to Law Number 19 of 2003 concerning State-Owned Enterprises (BUMN).
