KY Investigate Alleged Ethical Violations Of Judges Who Sentenced Harvey Moeis Lightly
The Judicial Commission (KY) is still conducting an investigation regarding alleged ethical violations by the panel of judges at the Central Jakarta District Court (PN Jakpus) who gave a light verdict to Harvey Moeis in the tin trading corruption case.
KY member Mukti Fajar Nur Dewata confirmed that the deepening was still ongoing, including the agenda for re-examination of the reporter who was previously unable to attend.
"Regarding reports of alleged violations of the code of ethics and code of conduct of judges against the judges of the Central Jakarta District Court, until now, KY is still investigating," Mukti said in Jakarta on February 18.
Mukti emphasized that although Harvey Moeis' sentence was increased at the appeal level to 20 years in prison, this did not automatically prove any ethical violations by the panel of judges at the first level.
"The panel of judges at the appeal level may have different beliefs after seeing the verdict along with the evidence and memorandum of appeal from the prosecutor," he said.
Harvey Moeis, who played the extension of PT Refined Bangka Tin (RBT), was initially sentenced to 6 years and 6 months in prison by a panel of judges at the Central Jakarta District Court Corruption Court.
However, in an appeal hearing at the DKI Jakarta High Court (PT), Thursday (13/2/2025), Harvey Mooeis' sentence in the tin trading corruption case was increased to 20 years in prison and a fine of Rp. 1 billion, subsidiary to 8 months in prison. In addition, he is also required to pay compensation of Rp. 420 billion or serve an additional 10 years in prison.
This case caused controversy because the verdict at the Central Jakarta District Court was previously considered too light even though this case caused state losses of up to Rp. 300 trillion.
Harvey Moeis was proven to have received IDR 420 billion along with the Manager of PT Quantum Skyline Exchange (QSE), Helena Lim, and committed money laundering (TPPU).
Harvey Moeis violated Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Corruption in Article 55 paragraph (1) 1 of the Criminal Code, Article 3 of Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering.
At the first level, Harvey was only sentenced to 6 years and 6 months in prison, a fine of Rp. 1 billion, subsidiary to 6 months in prison, and was required to pay compensation of Rp. 210 billion or an additional 2 years in prison.
The verdict received sharp criticism from various parties, who considered the punishment to be incomparable to the amount of state losses.

Responding to the light sentence, KY received a report on alleged violations of the code of ethics and code of conduct of judges (KEPPH) on Monday (6/1/2025). Currently, KY is still gathering evidence and information to determine whether there is an ethical violation in the Central Jakarta District Court's decision.
