Attorney For Bukalapak Denies Claims Of Debt In PKPU Lawsuit By Harmas
JAKARTA - The attorney for PT BUKALAPAK.COM Tbk (BUKA), Ranto Simanjuntak, regretted the lawsuit on the Suspension of Debt Payment Obligations (PKPU) filed by PT Harmas Jalesveva (Harmas) on January 10, 2025. According to him, the lawsuit was not legally appropriate because this dispute was a pure civil matter that should have been resolved at the District Court, not at the Commercial Court.
Ranto explained that this dispute is still in the process of being reviewed at the Supreme Court, so it cannot be used as a basis for submitting a PKPU. "We emphasize that our client does not have a debt obligation to fall time to Harmas. On the other hand, Harmas has not fulfilled its obligation to return the deposit funds that have been paid by BUKA," said Ranto.
The Beginning Of The PKPU Application
This PKPU application stems from Bukalapak's decision not to continue with the plan to rent an office room at Harmas' One Belpark Building. The decision was taken because Harmas was considered to have defaulted by failing to submit office space according to the agreed time target. In addition, the space submitted is also not suitable for use.
Harmas admitted that they were unable to continue their operations due to the legal problems they were facing. The operation of the One Belpark Building has been stopped since June 2018, which shows Harmas' inability to provide a decent office space. "With the cessation of the operation of the One Belpark Building, it is very clear that Harmas cannot fulfill its commitment to hand over office space to BUKA," said Ranto.
