Deputy Minister Of Home Affairs Affirms Gubernatorial Regulation Number 2/2025 Issued By Acting Governor Of Jakarta Tightens Polygamy Process

JAKARTA - Deputy Minister of Home Affairs (Wamendagri) Bima Arya Sugiarto emphasized that there are no new rules in the rules of marriage and divorce for State Civil Apparatus (ASN).

"Everything refers to Government Regulation (PP) number 45 of 1990 and BKN circular letter (State Civil Service Agency). So there is no new norm. Everything is the same. Even if there is something new, there is less regulation there about wives who have not been able to give birth for 10 years," Bima said when found at Jakarta City Hall, quoted from Antara, Monday, January 20.

In addition, Bima also said that Governor Regulation (Pergub) Number 2 of 2025 was actually aimed at tightening the polygamy process.

Bima explained that ASN is also a married person who needs to be fostered. Moreover, in Jakarta the divorce rate is quite high. For this reason, the regulation aims to protect the families of ASN.

Around 116 were reported (the divorce). Behind the divorce there is a story, there is a dynamic, there is something his ex-wife doesn't pay attention to his rights and so on. Meanwhile, this is our big family that we have to develop, which we have to make sure there is a legal basis. So actually, this Pergub is to provide legal certainty, clearer rules, about divorce and marriage processes," explained Bima.

So, Bima continued, the Governor's Regulation was not only passionate about polygamy problems, but also divorce and marriage.

On the same occasion, Acting Governor of DKI Jakarta Province Teguh Setyabudi said that his party would conduct socialization related to the Governor's Regulation.

"We will do socialization again, yes. One vision is right, that's right. Because the norm is, we don't make it easier, instead we tighten the existing rules," said Teguh.

Previously, it was reported that the Acting Governor of Jakarta, Teguh Setyabudi, officially issued Governor Regulation (Pergub) Number 2 of 2025 concerning Procedures for Provision of Marriage and Divorce Permits.

The governor's regulation was issued on January 6, 2025, and set a permit mechanism for ASNs who wish to have more than one wife.

In this regulation, male ASN who wish to be polygamous are required to obtain permission from the authorized official before holding the wedding. This provision is contained in Article 4 paragraph 1.

If an ASN violates the rule and marriages without a permit, a severe disciplinary punishment will be imposed, as stipulated in the applicable laws and regulations.
