Bobby Nasution-Surya Accused Of Violating TSM, The Edy-Hasan Team Asked The Constitutional Court To Cancel The KPU's Decision
JAKARTA - Candidate Pair for Governor and Deputy Governor of North Sumatra Number 2 Edy Rahmayadi-Hasan Basri Sagala, asked the Constitutional Court to cancel the local provincial KPU's decision regarding the determination of the results of the 2024 North Sumatra Pilkada.
The Edy-Hasan pair also asked the Constitutional Court to disqualify candidate pair number 1 Muhammad Bobby Afif Nasution and Surya for allegedly committing violations in a structured, systematic and massive manner (TSM) during the pilkada stage.
"There is a structured, systematic, and massive orchestration involving officials, there are pj. (officials) regional heads, law enforcement officials, and election organizers," said Edy-Hasan's attorney, Bambang Widjojanto, in the preliminary examination hearing of case Number 247/PHPU.GUB-XXIII/2025 at Panel 1 at Building I MK, Jakarta, quoted from Antara, Monday, January 13.
According to Edy-Hasan, the Bobby-Surya pair was indirectly supported by the Acting Governor of North Sumatra Agus Fatoni. This is allegedly because Agus Fatoni is said to be actively involved in Bobby Nasution who is also the Mayor of Medan in safari activities.
Bambang explained that Agus Fatoni often involved Bobby Nasution traveling to a number of districts/cities in North Sumatra which were wrapped with da'wah safari and safety prayers to knit ukhuwah in interpreting the spirit of PON XXI Aceh-North Sumatra 2024.
In addition, according to Edy-Hasan, Acting Governor of North Sumatra also posted a photo of Bobby Nasution on billboards of every activity that had nothing to do with a series of events.
"This can be considered as a strategic step from the governor in in introducing Bobby Nasution to the wider community in North Sumatra. Unfortunately he used funds from the regional government," said Bambang.
On the other hand, the Edy-Hasan camp also highlighted the football tournament of the Civil Service Corps of the Republic of Indonesia (Korpri) which was held by the Regional Secretary (Sekda) of North Sumatra. The tournament is for the Bobby Nasution Cup as an advisor to the Medan City Korpri.
"At the opening of the event, the statement from the Regional Secretary was deemed to have conveyed a hidden political message for the benefit, victory from the relevant parties (Bobby-Surya)," said Bambang.
In addition, the Edy-Hasan camp also mentioned that there was a letter from the Deli Serdang District Attorney regarding the filling of the ballot input link for each polling station (TPS). The letter was addressed to the head of the polling group (KPPS) throughout Deli Serdang Regency.
Bambang said that the Deli Serdang District Attorney's Office in the letter provided guidance and procedures for filling out votes. The recapitulation of regional elections is not the authority of the prosecutor's office so that the letter in question is considered to have taken over the duties of the KPU.
"Indeed, there was a letter that canceled the letter regarding the filling of the voice input link, but there was no guarantee that the actions of all other prosecutors in North Sumatra did not do the same. This is very worrying and beyond the reasonable limits allowed," he said.
Furthermore, Edy-Hasan questioned the low participation of voters in a number of districts/cities due to floods such as Medan City, Deli Serdang Regency, Binjai City, Langkat Regency, and Asahan Regency.
According to Edy-Hasan, BMKG has reminded the North Sumatra Provincial KPU about the potential for rain accompanied by floods and landslides. The BMKG and the local KPU also held a working meeting a few days before voting.
However, the North Sumatra Provincial KPU's efforts are considered not optimal in dealing with force majeure conditions such as the flood. Subsequent voting (PSS) and further voting (PSL) are considered to have not been able to boost voter participation.
"The KPU should be smarter in implementing PSS and PSL. Why not enforce such as for example mobile TPS for people who cannot be reached by TPS?" said Bambang.

Based on this argument, Edy-Hasan, among others, asked the Constitutional Court to cancel the results of the 2024 North Sumatra Pilkada, disqualify candidate pair number 1 Bobby-Surya, or order the KPU to re-vote at all polling stations in flood-affected districts/cities.
