The Low Verdict Of The Harvey Moeis Group After Being A Mirror Of The Decreased Law Enforcement In Indonesia
The 6.5-year sentence handed down by the judge to Harvey Moeis and his gang in the corruption case of managing tin commodity trading in the mining business permit (IUP) area has received attention. Coordinator of the Indonesian Anti-Corruption Society (MAKI) Boyamin Saiman said the low verdict for Sandra Dewi's husband was a sign that the panel of judges had no sense of sensitivity in realizing legal justice.
The defendant Harvey Moeis as the extension of PT Refined Bangka Tin (RBT) was sentenced to 6 years and 6 months in prison in connection with the corruption case in the management of tin commodity trading in the mining business permit (IUP) area of PT Timah Tbk. in 2015 '2022.
In addition to imprisonment, Harvey was also subject to a fine of Rp. 1 billion on the condition that if the fine was not paid, it was replaced (subsider) with imprisonment for six months. The Panel of Judges also imposed additional penalties on Harvey in the form of paying compensation of Rp. 210 billion, subsidiary to two years in prison.
The verdict read by the Chief Justice Eko Aryanto was much lighter than the demands made by the public prosecutor (JPU) of the Attorney General's Office. Previously, the Public Prosecutor asked Harvey to be locked up for 12 years in prison and a fine of Rp. 1 billion, subsidiary to one year in prison.
However, the judge's decision, which only sentenced Harvey Moeis to 6 years and 6 months, immediately caught the attention of the public. Prison for only six years is considered too light for a big case like the husband of actress Sandra Dewi.
Moreover, if you hear the reason the judge sentenced Harvey Moeis to be lighter than the prosecutor, it is only because the defendant behaved politely, had family responsibilities, and was never punished. Former Coordinating Minister for Political, Legal and Security Affairs Mahfud MD even surprised that he was sentenced to 6.5 years in prison for Harvey Moeis, even though the case cost the state hundreds of trillions.
"This is illogical, experiencing a sense of justice. Harvey Moeis was charged with corruption and a TPPU of Rp. 300 T. The prosecutor was only charged with 12 years in prison with a fine of 1 M and a replacement money of only Rp. 210 billion, the judge's verdict was only 6.5 years plus a fine and a replacement for a total of Rp. 212 M," said Mahfud MD.
Meanwhile, the Executive Director of the Nagara Institute, Akbar Faizal, also expressed his disappointment over the judge's decision which only handed down a light verdict for Harvey Moeis. Moreover, if you highlight the reason the judge gave a lower sentence than the prosecutor's demand because according to Akbar's polite and family behavior insulted the nation's logic and sense of justice.
"This is not the first time. Do you definitely understand how much the future of children and families can be embedded with the Rp271 T that this person and his network have stolen?" Akbar wrote on his X account.

Not only among important figures in the country, Harvey's low sentence after harming the state of up to hundreds of trillions is also unfortunate for the public. They also compare law enforcement in Indonesia and abroad in dealing with corruption cases.

MAKI Coordinator Boyamin Saiman said the panel of judges did not have a sense of sensitivity in realizing legal justice in the eyes of the public. In fact, according to Boyamin, the impact of corruption is very detrimental to the community.
"For example, the defendant Harvey Moeis, who was involved in tin corruption in Bangka Belitung, the environmental loss was already Rp. 270 T," said Boyamin.
He added that the panel of judges should give the defendant Harvey Moeis a life sentence.
The 6.5-year-old version is considered very light because today the case of Tipikor Budi Said, whose loss was only 35 billion, was sentenced to 15 years. This is far from the hope of justice because the prosecutor's demands are not optimal," he said.

According to Boyamin, light sentences in corruption cases are often triggered because the prosecutor's demands are low. If from the start the prosecutor's demands were applied optimally, Boyamin believed the verdict would follow. For cases of mining corruption and money laundering, a high sentence should be rewarded with life imprisonment.
