Constitutional Court Order, BNPT Reopens Service For Determination Of Past Terrorism Victims

JAKARTA - The National Counter-Terrorism Agency (BNPT) officially reopens the application service for a Letter of Determination of Past Terrorism Victims for the 2024-2028 Period from Monday, November 25 to June 8, 2028.

Director of BNPT Capability Development Brigadier General Imam Margono revealed that the service was a follow-up to the Constitutional Court Decision (MK) Number 103 PUU-XXI/2023.

"BNPT through the Sub-Directorate for Recovery of Victims of Past Terrorism Action follows up on the Constitutional Court's Decision 103 PUU-XXI/2023 by reopening the request for a letter to determine victims of past terrorism," said Imam in a confirmed statement in Jakarta, Antara, Tuesday, November 26.

The service is aimed at victims of past terrorism crimes who do not yet have a letter of determination of victims or their rights as victims of past terrorism that has not been fully fulfilled.

The Letter of Determination of Past Terrorism Victims by BNPT is one of the formal requirements for requests for victims of past terrorism, in accordance with the mandate of Article 43 L of Law Number 5 of 2018 concerning Amendments to Law Number 15 of 2003 concerning Stipulation of Government Regulations in Lieu of Law Number 1 of 2002 concerning Eradication of Criminal Acts of Terrorism into Law.

The flow of applications and the required supporting documents is clearly stated on the official BNPT website, namely www.bnpt.go.id and BNPT social media or can contact the BNPT Victim Recovery Sub-directorate at WhatsApp number 0811-1726-699.

The Constitutional Court's Decision Number 103/PUU-XXI/2023 contains a request for testing Article 43L paragraph (4) of Law Number 5 of 2018 concerning the Eradication of Criminal Acts of Terrorism (UU Terrorism).

In that decision, the deadline for submitting a request for compensation, medical assistance, or psychosocial and psychological rehabilitation for victims of terrorism to institutions that carry out affairs in the field of witness and victim protection was changed to 10 years from the previous only 3 years.

From the data collected as of September 2024, there were approximately 1,157 victims of past terrorism crimes. Of these, 492 victims have not been identified.

Meanwhile, the facilitation of compensation for victims of terrorism crimes in Indonesia in 2016-2024 which was paid by the state was recorded at Rp113.37 billion.

Compensation is channeled through the Witness and Victim Protection Agency (LPSK) assisted by BNPT to 785 victims and/or their families during that period through court decisions and compensation schemes for victims of past terrorism.
