The Police's Response To The Constitutional Court's Decision On 'Weakness' Can Be Convicted
The National Police stated that they remain committed to being professional and neutral during the 2024 Regional Head Election (Pilkada).
The statement was made in relation to the decision of the Constitutional Court (MK) number 136/PUU-XXII/2024 regarding the addition of the phrase giving imprisonment or fines to the Police and the TNI who are drunk.
"The National Police is committed to being neutral and not carrying out practical political activities in every stage of the 2024 General Election," said Karo Penmas, Police Public Relations Division, Brigadier General Trunoyudo Wisnu Andiko, Monday, November 18.
The National Police, continued Trunoyudo, will take firm action against all members who violate the applicable regulations. This was carried out to provide security and ensure that the simultaneous elections and regional elections in 2024 were safe, peaceful and dignified
"The neutral police as mandated by law, the National Police itself has made a circular through TR to the ranks to act neutrally and not to side with any of the candidates in the elections, presidential and regional elections," said Trunoyudo.

Meanwhile, with the Constitutional Court's decision, members of the TNI-Polri can be convicted if they are not neutral or support one of the candidate pairs during the Pilkada administration in accordance with Article 188 of Law Number 1 of 2015
Thus, Article 188 of Law Number 1 of 2015 now reads;
'Every state official, regional official, state civil servant official, TNI/Polri member, and village head or other designation/lurah who deliberately violates the provisions as referred to in Article 71, shall be punished with imprisonment for a minimum of 1 month or a maximum of 6 months and/or a fine of at least Rp. 600,000.00 or a maximum of Rp. 6,000,000.00.
