Army/ART Unclear And FIBA Statutes Hit, Perbasi Smooths Jalan Budisatrio To Become General Chair
JAKARTA Budisatrio Djiwandono, a candidate for the General Chairperson of the Central Board of the Indonesian Basketball Association (PP Perbasi) for the 2024-2028 term, is certain to rise smoothly as chairman.
The reason is, the nephew of the elected President Prabowo Subianto is certain as the sole candidate who will run in the election market for the General Chairperson of Perbasi.
Budi is actually not the only name who came to take the registration form to the Perbasi Office at the GBK Arena, Senayan, Jakarta. There is still one other name, namely Yos Paguno.
This second name is not a foreigner in the basketball world. He has full experience in basketball, both as team manager and as administrator.
He is noted to have served as Chairman of the East Jakarta Perbasi City Management (Pemkot) for the period 2015 to 2017 and Chairman of the DKI Jakarta Provincial Management (Pengrov) for the period 2017 to 2022.
However, it has been confirmed that he will not participate in the competition at the PP Perbasi National Conference (Munas) on October 28-30, 2024.
Yos is sure not to enter the stock exchange for the general chairman candidate after not returning the registration form until the deadline set for Monday, September 23, 2o24, at 17.00 WIB.

Thus, hoping to see two candidates compete openly and fairly to become the General Chair of PP Perbasi for the 2024-2028 term of service will certainly not be realized.
Budi has also returned the form on Friday, September 20, 2024. He received written support from 28 Perbasi Provincial Pengprov (Provincial Manager) or almost double the minimum number of requirements to advance to become a candidate for general chairman, namely the support of 15 Perbasi Pengprov.
One other support will follow so that he may be supported by 29 Perbasi Pengprov during the National Conference later. This fat support automatically closes the chances of other interested figures.
Currently Perbasi is recorded to have 31 active Pengprov who have voting rights. Thus, if there are other candidates who are interested in participating in the automatic constellation, they do not have the power anymore because there are only two Pengprovs left that can be picked up.
This condition is clearly very far from the minimum number of requirements set so that the person concerned will automatically fall during the document verification.
The requirement to have the support of 15 Pengprov is allegedly the way PP Perbasi smoothed Budisatrio's steps.
Not surprisingly, criticism also came from basketball observer, Hisia Martogi Lumban Gaol.
He said that this requirement was too far-fetched and did not show the spirit of democracy at all.
"Because the conditions made violate the statutes of AD/ART and FIBA," he said.
The Head of the Penjaringan Team for the Candidate for the General Chair of Perbasi, Setia Dharma Madjid, confirmed that the requirement to have minimal support from the Pengprov was not in the organization's AD/ART.
"That decision was made in the plenary meeting of the management regarding the National Conference," he said.
Therefore, Togi also finds it strange that as an organization, Perbasi should have rules and procedures that must be followed in the process of nominating and selecting leaders or administrators.
These rules are usually listed in the Articles of Association and Household (AD/ART) as well as organizational statutes. Unfortunately, this was not done by Perbasi.
This means that without clear rules, the practice of smoothing out one of the candidates has a high probability of happening not only at this time, but also in the future.
These arrangements make the face of the organization tarnished because the value of democracy is lost.
"As members of the organization, we must comply with these rules in order to maintain democratization and justice in the election process," he said.
Apart from the unclear AD/ART which led to the practice of smoothing out one of certain candidates, the election regulations for the General Chairperson of Perbasi also hit the FIBA Statute.
Togi further emphasized that if there are things that are contrary to organizational regulations, then these regulations need to be corrected, corrected, or revoked.
This must be done by the organization concerned so that the process of nominating and selecting leaders and administrators can be carried out fairly and transparently.
The clean process in an election, he said, is very important to maintain the integrity and trust of organizational members.
This affirmation is contained in the FIBA Statute, in article 9.7 to be precise. The article states that national federations must carry out the selection process in a democratic, transparent, and accountable manner which is carried out every four years.
"From some articles, there is no signal to make new rules by the screening team."
"Moreover, the rules are against the spirit of democracy, the spirit of change and looking for a figure to become the leader of the national basketball organization," said Togi, who was once the administrator of the 2015-2019 PP Perbasi.

If you refer to AD/ART, it has actually been explained firmly that the participants of the National Conference and the owner of the vote are the Pengprov and the Regency/City Government (Regency or City Manager).
Therefore, there must be equal rights, aka the egalitarian principle of each board to be able to provide support to the candidates.
Togi said that there is no guarantee that someone who does not receive support from the Pengprov is someone who is not worthy of leading the organization.
On the other hand, figures who have received a lot of support from the Pengprov are not necessarily people who deserve to head an organization.
"Why not make a rule that a candidate will be the son of the king, the nephew of the king, or a conglomerate?" he said.
Next, Togi emphasized that to uphold the spirit of democracy, such methods should be removed. The reason is, in democracy everything is equal.
"Let the National Conference (the owner of the vote) be the judge and decide to choose his choice not to be hampered by regulations that do not exist at the FIBA and AD/ART Perbasi Statutes," he said.
Another requirement that Togi also highlighted was the obligation of the general chairman candidate to deposit funds amounting to Rp500 million.
According to him, a person who deposits the nominal cannot be an indicator of a person's feasibility to be able to guide an organization rather than people who do not have money.
"In leadership, it is not money that becomes the benchmark. Therefore, it is necessary to correct the terms or criteria of this."
"In my opinion, the committee only accommodates candidates who do not have the right to decide whether or not a candidate is legal," he said.
As mentioned earlier, Togi also agreed that the candidate exchange for the General Chairperson of Perbasi for the 2024-2028 term of service had been carried out in camps to support certain candidates.
In fact, all candidates should communicate with all basketball administrators throughout Indonesia.
"Even though it's legal, the main thing is the unity of the entire basketball community to achieve the highest achievement," he said.
