Father Of Rape Son Of Kandung In Ambon Sentenced To 20 Years In Prison

JAKARTA - The Ambon District Court (PN) in Maluku sentenced Dehamphetamine, a defendant in the crime of rape of his biological child for 20 years in prison.

"Declaring that the defendant is legally and convincingly proven guilty of violating Article 81 Paragraph (3) of the Republic of Indonesia Law Number 23 of 2002 concerning child protection, and imposing a sentence of seven years in prison," said Chairman of the Ambon District Court Panel of Judges Orpa Marthina accompanied by two member judges at the trial in Ambon, Tuesday, September 24, confiscated by Antara.

In addition to imprisonment, the defendant was also sentenced to pay a fine of Rp. 500 million, subsidiary to six months in prison.

"What burdens the defendant is being sentenced to prison because his actions have continued to undermine the future of the victim, who is a biological child and is still a minor and is a continuing act," said the panel of judges.

Meanwhile, the mitigating factor is that the defendant was polite in the trial and had never been convicted.

According to the judge, the defendant was proven to have abused the victim who was still a minor continuously from 2023 to 2024 three times.

The verdict of the panel of judges is the same as that of the Public Prosecutor (JPU) of the Central Maluku Kejari Ryan Lopulalan in the previous trial, with a sentence of 20 years in prison and a fine of Rp. 500 million, subsidiary to six months in prison.

Based on this decision, neither the prosecutor nor the defendant through their legal advisors have yet to express their attitude of accepting or making an appeal to the Ambon High Court (PT).

"This decision has not been submitted or has permanent legal force, so it is given the opportunity for seven days to think about it, and if there is no answer then the decision has been considered accepted," said the panel of judges.

The trial process with the agenda of reading the verdict of the panel of judges was disturbed because the defendant's wife made a fuss.

The prosecutor said the defendant's actions against his biological child had been carried out since 2023 when the victim was still in school.

"Then the victim suspected the incident to one of his relatives in Ambon City, so it was reported to the Maluku Regional Police," said the prosecutor.

After the trial, the defendant's wife cried hysterically outside the courtroom and said that her son (the victim) had made an incorrect confession, causing her husband to be sentenced to 20 years in prison.
