Owner Of 1,010 Happy Five Pills Sentenced To 6 Years In Prison At Medan District Court

The panel of judges at the Medan District Court (PN) sentenced the defendant Muhammad Syawal (28) to six years in prison because he was proven to have 1,010 happy five pills, 61 ecstasy pills, 0.74 grams of crystal methamphetamine, and 7.80 grams of ecstasy powder.

"Therefore, the defendant was sentenced to six years in prison," said Chief Judge Erianto Siagian as quoted by ANTARA, Thursday, August 8.

The judge also imposed a fine of Rp. 1 billion, provided that if the fine was not paid, it would be replaced with imprisonment for three months.

The judge believes that the defendant, a resident of Jalan S Parman, Petisah Tengah Village, Medan Petisah District, Medan City, was found guilty of violating the law.

Then own, store or control class I narcotics in the form of non-plants weighing more than five grams, as in the indictment of the first subsidiary of the public prosecutor.

"The defendant's actions are as regulated and subject to criminal penalties in Article 112 paragraph (2) of Law Number 35 of 2009 concerning Narcotics," he said.

In addition, the defendant was also legally proven guilty of having, storing and/or carrying psychotropically as indicted by the second subsidiary of the public prosecutor.

"The defendant was proven to have committed a criminal act as regulated and threatened with Article 62 of Law Number 5 of 1997 concerning Psychotropics," said Erianto Siagian.

This verdict is the same as the demands given by the Public Prosecutor (JPU) of the Medan Kejari, because previously he demanded that the defendant be sentenced to six years in prison.

Previously, AP Public Prosecutor Frianto Naibaho in the indictment stated that this case occurred on Thursday (8/2), when police officers received information, on Jalan Kelambir V, Tax Kampung Lalang, Medan City, drug transactions often occur.

"The police then headed to the location and saw Sibay (separate files) sitting throwing away 100 happy five pills, when they saw the arrival of the officers. However, the officers immediately arrested Sibay," he said.

From Sibay's confession, said Frianto, he bought the narcotics from the defendant Muhammad Syawal, and the officers carried out a raid at the house of the defendant Muhammad Syawal.

"In addition to arresting the defendant, officers also confiscated evidence in the form of 1,010 happy five pills, 61 ecstasy pills, one plastic package containing 30 ecstasy pills, one plastic clip containing 7.80 grams of ecstasy powder and one plastic clip containing 0.74 grams of crystal methamphetamine," said Frianto Naibaho.
