ICJ Legal Fatwa Breaks Israel's Arguments, Indonesian Ministry Of Foreign Affairs: Palestinians Have The Right To Determine Their Own Fate

JAKARTA - The legal fatwa issued by the International Court (ICJ) last week confirmed the Palestinian right to determine its own destiny, breaking Israel's argument, said Director General of Asia Pacific and Africa of the Indonesian Ministry of Foreign Affairs Abdul Kadir Jailani on Monday.

The ICJ in its legal fatwa published Friday last week said Israeli settlement policies and exploitation of natural resources in the Palestinian territories were violations of international law.

Indonesia positively welcomes the fatwa, although the provisions of the ICJ, known as the World Court, are not binding but have international legal weight.

Ambassador Kadir said the fatwa was important with the court breaking Israel's argument over its occupation of Palestine. The Court also did not consider claims of historical rights that were not requested by the UN General Assembly (UNGA), as the party requesting a fatwa.

He explained that Israel has always justified its actions in Palestine so far under the pretext of historical rights, so it has the right to control Palestinian territory.

"Israel always delivers strong international law arguments, but this (ICJ) decision breaks all Israel's arguments so far," he explained in a press statement Monday, July 22.

"This means that the new ICJ fatwa, the Palestinian people have the right to determine their own destiny, this is with the territory of the West Bank, the Jordan River and Gaza," said Ambassador Kadir.

He further explained that the fatwa also established Israel's status as a occupation force, so that Israel never had and was not entitled to Palestinian territory, had no right to anything.

"ICJ is of the view that Israel has carried out violent annexation of Palestinian soil, considered to be discriminating, all Israeli actions taken on Palestinian soil are considered contrary to international law, the consequences are that Israel's presence in the West Bank, the Jordan River and Gaza must be ended immediately," he said.
