Coordinating Minister For Political, Legal And Security Affairs Kaji Proposes Article Prohibition Of The TNI For Business
JAKARTA - The Indonesian Ministry of Political, Legal and Security Affairs (Kemenko Polhukam) is discussing the proposal to remove articles that prohibit TNI personnel from running a business in the TNI Law Number 34 of 2004.
The Coordinating Minister for Legal and Security Politics, Marshal TNI (Ret.) Hadi Tjahjanto, quoted by ANTARA, Wednesday, July 17, explained that the discussion was carried out by the ranks of the Coordinating Ministry for Political, Legal and Security Affairs in the context of the TNI Bill's Problem Intervention List (DIM).
"Yes, this is still in process, yes, we, especially for the TNI, are Articles 47 and 53, but related to business activities, this is still under discussion," said Hadi.
To note, two articles that Hadi mentioned were the matter of extending the term of office and placing TNI personnel in public positions.
According to Hadi, all parties have the right to provide input to him to ensure that the TNI Bill is appropriate for the needs of the community.
Parties from the TNI also have the right to propose if they think the law is irrelevant to the current situation.
"Because it has been 20 years since the TNI Law has been running, and we have to adjust to the current needs," said Hadi.
Therefore, he ensured that all input, including removing the ban on doing business, would be carefully considered.
Hadi will also listen to opinions from experts to academics in the process of DIM TNI Bill before being submitted to parliament.
"Yes, indeed DIM until August (finished)," said Hadi.
Previously, it was known that the TNI proposed to the Coordinating Ministry for Political, Legal and Security Affairs to abolish the prohibition of TNI members from opening businesses listed in Article 39 letter C in Law of the TNI Number 34 of 2004.
The proposal was conveyed by a member of the TNI in a discussion forum provided by the Coordinating Ministry for Political, Legal and Security Affairs to discuss the TNI Bill in Central Jakarta.

The proposal then sparked various responses from the community from observers to academics.
Article 39 of the 2004 TNI Law explains several things that are intended for members of the TNI, including prohibited from becoming members of political parties, prohibited from engaging in practical political activities, prohibited from engaging in business activities and lastly prohibited from being involved in activities aimed at being elected as members of the legislature or other political positions.
